On December 2, according to Thanh Nien reporter's source, Ngoc Hien District Police (Ca Mau) announced receiving information about crimes reported by people against 2 officials and 1 former leader of Kien Vang Protective Forest Management Board.

Accordingly, Mr. Thai Van Vi (66 years old, residing in Rach Goc Town, Ngoc Hien District, Ca Mau) accused 2 officials and 1 former leader of Kien Vang Protective Forest Management Board of violating regulations on belt management occurring in Hamlet 4, Rach Goc Town.

"Currently, the Ngoc Hien District Police Investigation Agency is handling the case according to the crime reporting procedure," the source informed.

Mr. Vi stated in the complaint that in 1990, he had cleared a part of the forest land in Rach Goc hamlet, Tan An commune, Ngoc Hien district (now in group 4, Rach Goc town), the land was located near Kinh Ca Thap, stretching from Kinh Ba to near Kinh Ong Nam.

Mr. Vi is currently raising shrimp on the disputed land.

"In 1995, I transferred a part of the cleared forest land to Mr. Huynh Van Ut and Mrs. Ngo Ngoc Giao (living in the same locality). At that time, my family had an agreement with Mr. Ut's couple that I would keep the land from Kinh Ba River up about 80 m (about 130 m wide), the rest would be transferred to Mr. Ut's couple. Regarding the remaining area after the transfer, in 2012, my family has been raising industrial shrimp until now," Mr. Vi stated in the application.

According to Mr. Vi's complaint, the land he transferred to Mr. Ut and his wife in 1999 was contracted by Kien Vang Forestry and Fishery (now Kien Vang Protective Forest Management Board), the contracted area was only 4.76 hectares. By 2014, Kien Vang Protective Forest Management Board, converting the 1999 contract to a new contract, the land area of ​​Mr. Ut and his wife increased from 4.76 hectares to 5.67 hectares.

On October 26, 2021, Mr. Q.D, representing the Kien Vang Protective Forest Management Board, signed a reply to the People's Court of Ngoc Hien District with the following content: "...In 1999, the Kien Vang Protective Forest Management Board signed a contract to allocate land to Ms. Ngo Ngoc Giao's household with an area of ​​56,739 m2 . Contract No. 589 dated June 3, 2014 did not change the contracted area...".

In addition, in the first instance judgment (No. 21/2022/DS-ST dated March 31, 2022), Mr. LTD's opinion was also stated that "The difference in the area between the issuance of the contract book in 1999 and the change of the book in 2014 was due to the fact that in 1999 the measurement was manual, in 2014 the measurement was done with a specialized machine, so there was a change in the area...".

"When invited to work by the People's Court of Ngoc Hien District, the leaders of the Kien Vang Protective Forest Management Board denied responsibility, claiming that the land allocation to Mr. Ut and his wife under the 2014 contract was only a change from the 1999 contract, and did not accept the increase in area even though the contract clearly stated that the area had increased," Mr. Vi said indignantly.

From there, Mr. Vi filed a criminal complaint to the Investigation Police Agency of Ngoc Hien District, accusing Mr. LVT, Mr. Q.D and Mr. LTD of abusing their positions and powers to illegally allocate land to Ms. Ngo Ngoc Giao, showing signs of the crime of "Violating regulations on land management" according to Article 229 of the Penal Code.

In March 2020, Ms. Ngo Ngoc Giao filed a lawsuit against Mr. Thai Van Vi at Ngoc Hien District People's Court for arbitrarily occupying Ms. Giao's land, thereby forcing him to dismantle the construction and return the land to Ms. Giao.

At the first instance, the People's Court of Ngoc Hien District accepted the lawsuit of Ms. Ngo Ngoc Giao, forcing Mr. Vi to return the land to Ms. Giao. Disagreeing, Mr. Vi appealed and at the appeal hearing, the High People's Court in Ho Chi Minh City declared that it did not accept the lawsuit of Ms. Ngo Ngoc Giao. On September 13, 2023, the High People's Court in Ho Chi Minh City annulled the entire appeal judgment, upholding the first instance judgment of the People's Court of Ngoc Hien District.
