If a driver has not paid a traffic violation fine, can he/she be granted or have his/her driver's license changed?

The National Assembly passed the draft Law on Road Traffic Order and Safety on June 27. The law consists of 9 chapters and 89 articles, and will take effect from January 1, 2025.

Notably, Clause 4, Article 62 of this law on granting, exchanging, re-issuing and revoking driving licenses stipulates that driving licenses will not be granted or exchanged for people who have not completed paying traffic violation fines.

Violators who have not paid the fine will not be granted or have their driving license changed.

Specifically, a driver's license (GPLX) is only issued to those who take the driving test and have passed the required results. The content of the driving test must be consistent with the driving license class and the driving training program. Car driving tests must be conducted at driving test centers; motorcycle driving tests must be conducted at driving test centers or at driving practice grounds that meet the conditions and standards for facilities and techniques.

A person with a driving license can have his/her driving license changed or reissued in the following cases: The driving license is lost; The driving license is damaged and no longer usable; within the time limit stated on the driving license; the information stated on the driving license is changed; The foreign driving license issued by a competent foreign authority is still valid; The driving license is issued by the Ministry of National Defense or the Ministry of Public Security upon request or the person granted it is no longer performing national defense or security duties.

For traffic violations, drivers must pay fines before being issued or having their driver's license changed.

Also in Clause 4, Article 62 stipulates: Not to issue, change, or reissue a driving license to a person who violates road traffic order and safety when that person has not yet completed the request of the competent State agency to resolve the case of administrative violation in the field of road traffic order and safety.

Thus, from January 1, 2025, if a driver violates road traffic safety and is fined but has not paid the fine, the issuance, exchange, or re-issuance of a driving license will be refused. Only after paying the administrative fine will the issuance, exchange, or re-issuance of a driving license be processed.
