Removing obstacles when implementing the 2024 Land Law
At the meeting, voters reflected on a number of people's issues; including many opinions and recommendations to remove obstacles related to the implementation of the 2024 Land Law.
Proposing to remove obstacles for the investment project to build Ring Road 4 - Capital Region when implementing according to the Land Law 2024, voter Nguyen Khac Hai (Me Linh District Land Fund Development Center) said that before August 1, 2024, Me Linh District People's Committee had determined specific land prices to calculate land use fees when allocating resettlement land to 145 households whose land was recovered under the project (households received compensation and paid resettlement land use fees from 20.1 million VND to 30.8 million VND/m2). Currently, Me Linh District still has households that have not approved compensation and support plans and have not been arranged for resettlement. Implementing the 2024 Land Law, using the Land Price List as the basis for calculating land use fees when allocating resettlement land is very low, leading to difficulties in implementation. Households who have been allocated land before have made comparisons and made many recommendations, causing difficulties in project site clearance.
Voters recommend that National Assembly deputies consult with competent authorities to allow the district to continue determining land use fees to allocate resettlement land to households according to the specific land prices that have been implemented, ensuring consistency in "one project, one policy".
Voters of Trang Viet commune (Me Linh district) raised the issue that the Hanoi People's Committee issued Decision No. 61/2024/QD-UBND dated September 27, 2024, regulating important contents related to land management and use, including regulations on conditions for dividing and separating land plots (effective from October 7). Voters asked which regulations should be followed if people submit applications for land division and separation before October 7? Voters also recommended that the city soon issue a new set of administrative procedures to facilitate people in completing the procedures.
At the request of the Chairman of the City People's Committee, Director of the Department of Natural Resources and Environment Le Thanh Nam responded to voters' petitions on issues within the management field.
Director of the Department of Natural Resources and Environment Le Thanh Nam said that, based on the provisions of the 2024 Land Law, which will take effect from August 1, 2024, the Ministries have issued decrees and circulars guiding its implementation; Hanoi City has issued Decision No. 61-QD/UBND as well as decisions on land prices and site clearance. The Department is still receiving procedures from people and has a direction for handling cases of land division.
Regarding the content of Decision No. 61 on the conditions for dividing residential land plots, the Director of the Department of Natural Resources and Environment informed that the increase in the area of land division is to ensure civilized urban development and minimum living conditions for people. In the near future, the Department will conduct intensive training for the whole city and promptly issue a set of administrative procedures to serve the people...
Voters propose to increase support level for damage caused by natural disasters
Meanwhile, voter Nguyen Khac Han (Kim Hoa commune, Me Linh district) proposed to adjust Decree No. 02/2017/ND-CP dated January 9, 2017 of the Government on mechanisms and policies to support agricultural production to restore production in areas damaged by natural disasters and epidemics, because the level of damage support under this Decree is not suitable to the current situation.
Voter Nguyen Khac Han cited that recently, due to the impact of storm No. 3 and the rising water levels of the Red River and Ca Lo River, it has affected and damaged crops, aquatic products, and livestock in Me Linh district. The district has directed to promptly overcome the consequences caused by storms and floods. In particular, it has proactively arranged the budget to support farmers to restore damaged agricultural production according to Decree No. 02-ND/CP. However, the support level according to the Decree is very low, insignificant. For example, the support level for rice is only 2-3 million VND/ha; for seedlings, 20-30 million VND/ha; for perennial fruit trees that were completely lost, it is 4 million VND/ha...
“To encourage and motivate people to promptly overcome the consequences of natural disasters, the People request that National Assembly deputies report, make recommendations, and propose that the Government consider increasing the level of support for crops, livestock, and aquatic products damaged by natural disasters in accordance with the actual situation” - voter Nguyen Khac Han suggested.
In addition, voters in Me Linh and Soc Son districts also recommended that the Ministry of Home Affairs provide guidance on encouraging learning and talent; promptly allocate capital to implement school projects; review dike routes, ensure traffic infrastructure on the left Hong dike, etc.
Make full use of documents, especially the Capital Law 2024
Regarding voters' proposal to increase the level of support for crops, livestock, and aquatic products damaged by natural disasters, Deputy Director of the Department of Agriculture and Rural Development Nguyen Manh Phuong said that the city has proposed the Government to amend and supplement Decree No. 02/2017/ND-CP, including increasing the level of support for production recovery in areas damaged by natural disasters and epidemics. Currently, the draft replacement Decree is being appraised by the Ministry of Justice before being issued by the Government. Regarding the support policy after storm No. 3, the city has an indirect policy of preferential interest rate loans to restore production and business through the Social Policy Bank and entrusted financial institutions; direct support through maximum application of documents, especially the Capital Law, to enhance the city's authority in providing direct support to the people.
Regarding the issue of ensuring the traffic infrastructure of the Red River dike, Deputy Director of the Department of Agriculture and Rural Development Nguyen Manh Phuong said that every year the city conducts maintenance and repair of traffic infrastructure on the dikes. In the coming time, the city is planning to synchronously renovate traffic on the dikes as proposed by voters. The project is currently conducting a pre-feasibility study; the Department will review all dikes to ensure synchronous renovate traffic infrastructure.
Regarding the recommendations to remove obstacles when implementing the 2024 Land Law, Chairman of the City People's Committee Tran Sy Thanh further analyzed that the implementation of the new policy requires a transfer, this is an issue that must be handled delicately and smoothly. The Chairman of the City People's Committee requested that the two districts of Me Linh and Soc Son summarize voters' opinions and immediately send a document to the Department of Natural Resources and Environment for response. "Situations such as those reported by voters and how to handle them also need to be thoroughly trained to districts, wards and communes" - the Chairman of the City People's Committee emphasized.
Regarding voters' petition to increase the level of support for people affected by natural disasters, the Chairman of the Hanoi People's Committee said that Hanoi has made full use of current documents to provide the highest level of support for people. Chairman of the City People's Committee Tran Sy Thanh affirmed that the delegation will fully absorb voters' opinions and recommendations, synthesize and report to the Hanoi National Assembly Delegation to report to the National Assembly, as well as request competent agencies to resolve them according to their authority.
At the meeting with voters, the Hanoi National Assembly Delegation coordinated with the City Labor Federation to present 30 gifts, each worth 1 million VND, to workers and laborers in difficult circumstances in Me Linh district.
