Ward chairman and vice chairman disciplined for eviction of wrong house

On August 23, news from the People's Committee of Ca Mau City (Ca Mau) said that the Chairman of the People's Committee of Ca Mau City has just issued a disciplinary decision against the Chairman and Vice Chairman of the People's Committee of Ward 5 for forcing the wrong house.

Accordingly, Mr. Le Thanh Tung, Chairman and Mr. Le Ba Truyen, Vice Chairman of Ward 5 People's Committee, were disciplined with a reprimand for being involved in the enforcement of illegal construction works in Ward 4 that were not strict, leading to errors.

Accordingly, on September 8, 2017, the Chairman of the People's Committee of Ca Mau City issued a decision to impose an administrative fine of VND 7.5 million on Mr. Chiem Buul Cot (in Hamlet 4, Ward 5) for constructing an urban housing project without a construction permit. At the same time, he was forced to stop construction and demolish the part of the construction project that violated urban construction order.

After that, Mr. Cot paid the fine but still did not demolish the illegal construction. To ensure the implementation of the penalty decision, the Chairman of the People's Committee of Ca Mau City issued a decision to enforce the remedy of the consequences.

At 8:00 a.m. on March 13, 2023, as planned, the Urban Management Department, relevant agencies, and Ward 5 People's Committee proceeded to enforce Mr. Cot's construction. After implementing the enforcement decision, Mr. Cot requested to voluntarily dismantle the violating construction and requested support from the force to dismantle it.

During the demolition, a person claiming to be a relative of Ms. Truong Mong Thuy asked to stop because they had already demolished the house of Mr. Nguyen Chi Nguyen and Ms. Thuy. However, this person did not provide relevant documents so the force continued to demolish.

At 3:00 p.m. the same day, upon receiving Mr. Nguyen’s request and violation records, the enforcement force stopped the demolition, but by then had already finished dismantling the corrugated iron roof and prefabricated iron frame of Mr. Nguyen’s house. The remaining construction walls had not yet been dismantled.

According to the records, in 2017, Mr. Nguyen Chi Nguyen built a house next to Mr. Cot's house and was administratively fined for illegally building a house with an iron frame and corrugated iron roof, and was forced to demolish the part of the construction that violated urban construction order. However, at the time Mr. Nguyen's house was demolished as mentioned above, the authorities had not yet made a decision to enforce it.

It is known that Mr. Nguyen sent a complaint to the Director of Ca Mau Provincial Police and the Provincial People's Procuracy because he believed that the enforcement team had destroyed property.
