Reflecting to Thanh Nien Newspaper recently, Mr. Van Hung Phuong, Director of V-Home Building Management Company Limited (V-Home), said that on November 2, his company at the social apartment building SSH-08, Le Hong Phong I New Urban Area, Phuoc Hai Ward, Nha Trang City was attacked by dozens of people from Ha Quang Real Estate Joint Stock Company (Ha Quang Company) who forcibly forced and assaulted employees to gain management rights.
Management unit accuses investor of assault
According to Mr. Phuong, the source of the incident started in early 2021, at that time the SSH-08 social apartment building invested by Ha Quang Company had just come into operation but had not yet established a Management Board.

After that, Ha Quang Company signed a contract to hire V-Home Company to perform the management and operation, with a term until February 2023. After the term expires, Ha Quang Company will let V-Home continue to perform the management and operation services of SSH-08 building.
On May 28, 2023, at the first apartment conference, the residents unanimously voted 100% in agreement that V-Home Company will continue to provide management and operation services for the SSH-08 apartment building until the Management Board is approved by the Nha Trang City People's Committee and will consult residents on the selection of a management and operation unit. This was recorded in the meeting minutes and was agreed upon by the People's Committee of Phuoc Hai Ward, representatives of residents and Ha Quang Company.
V-Home believes that, while the Management Board has not been established, this is a valid decision passed by the highest authority in the apartment building, the residents' conference (as stipulated in the Housing Law). At the same time, it said that the company has been providing management and operation services with the best, safest, most effective and cost-saving services for residents.
However, according to the Director of V-Home, recently, Ha Quang Company has continuously issued unilateral documents requesting V-Home to hand over management rights to the investor from November 2, 2023.
While waiting for the Nha Trang City People's Committee to handle and resolve the matter, on the morning of November 2, dozens of officers, employees, and security guards of Ha Quang Company came to V-Home's office at SSH-08 apartment building to enforce and demand the handover of building management rights. V-Home's employees were even assaulted by Ha Quang Company's people. "They came in large numbers of 30-40 people and took all the company's files and documents away even though they were V-Home's private property. We could only helplessly watch them take our belongings away," said the Director of V-Home Company.
Investor says management company cut off power, barricaded in building
A representative of Ha Quang Company said that on October 16, 2023, the company sent a written notice to V-Home about the termination of the management and operation service contract for the SSH-08 apartment building. At the same time, there were many documents requesting V-Home to hand over the items according to the contract, but the company still delayed the handover.
SSh-08 apartment building invested by Ha Quang Company was put into operation in 2021.
Chairman Ha Quang affirmed that the reason for terminating the contract with V-Home Company was because the quality of the company's management and operation services did not meet the requirements of the contract, causing many negative issues in the handling of technical machinery, environmental sanitation, security protection, and fire prevention and fighting. Up to now, these violations have not been promptly and thoroughly resolved...
Ms. Vo Khanh Yen, Deputy General Director of Ha Quang Company, said that the company has now taken over the management and operation of the SSH-08 apartment building from V-Home, and has repaired some items in the building to ensure the quality of life of residents.
Regarding the case between Ha Quang and V-Home, according to Ms. Yen, this is a civil matter, so the company has assigned the legal department to consolidate the documents to carry out related procedures.
Regarding the Director of V-Home accusing employees and security guards of Ha Quang Company of assaulting his company's people, the Deputy General Director of Ha Quang Company said that at the time of the incident, V-Home had instructed its employees to barricade themselves in the technical room, and at the same time turned on the fire alarm, causing the building to lose power for about 15 minutes, which is when the fight broke out. "There was no beating, the company will have an official press release about this," said Ms. Yen.
Speaking to Thanh Nien , Mr. Phan Tan Dung, Chairman of Phuoc Hai Ward People's Committee, said that after receiving the incident, the ward directed the ward police to go directly to the scene and invite representatives of V-Home and Ha Quang to work. "The ward's responsibility is to not let insecurity and disorder affect the lives of residents in the building," Mr. Dung said.
Regarding the reason why a conference has not yet been held to elect the Management Board at SSH-08 apartment building, the Chairman of Phuoc Hai Ward People's Committee said that through reviewing the personnel participating in the Management Board, most of the nominees and candidates are cadres, civil servants and public employees currently working in the state administrative apparatus. If elected, according to regulations, they will have their own seal, legal status and account, however, according to the law, this will not be correct.
"The ward is also asking for the city's direction to be able to organize a conference for the SSH-08 apartment building to establish a Management Board to soon stabilize the situation," said Mr. Dung.
