Transporting kumquat and peach blossoms by motorbike is a profession chosen by many people to earn a living at the end of the lunar year. However, in order to earn extra income, those who practice this profession will face the risk of being fined when checked by the Traffic Police.
If caught by traffic police carrying cumbersome peach and kumquat trees, motorcyclists can be administratively fined according to the law.
Specifically, according to point k, clause 3, Article 6 of Decree 100/2019/ND-CP, it is stipulated as follows:
“ 3. A fine of between VND 400,000 and VND 600,000 shall be imposed on a driver who commits one of the following violations:
k) A person driving a vehicle or carrying a passenger while holding, pulling, pushing another vehicle or object, leading an animal, carrying bulky objects; carrying a person standing on the saddle, on the cargo rack or sitting on the steering wheel; loading goods on the vehicle beyond the prescribed limit; driving a vehicle towing another vehicle or object .
According to this regulation, traffic participants will be fined from 400,000 to 600,000 VND if they carry bulky peach and kumquat trees on the road.

In addition, when performing the above actions and causing a traffic accident, the motorcyclist will be fined and have his/her driving license revoked for 2 to 4 months (according to Point c, Clause 10, Article 6 of the Decree on penalties for traffic violations).
If carrying bulky peach or kumquat trees causes an accident to other traffic participants, the motorcyclist will have to compensate according to the provisions of the 2015 Civil Code.
Specifically, based on Article 601 of the current Civil Code, motor vehicles, including motorbikes, are listed as one of the sources of high danger.
For damages caused by motorbikes, the vehicle operator will be responsible for compensation including:
- Damages caused by property infringement: Compensation for lost, destroyed or damaged property. Compensation for benefits associated with the use and exploitation of lost or reduced property. Compensation for reasonable costs to remedy the damage.
- Damages due to health damage: Compensation for reasonable costs for treatment, care, health and functional recovery of the injured person. Compensation for actual lost or reduced income of the injured person. Compensation for reasonable costs and actual lost income of the injured person's caregiver during the treatment period.
In particular, if the injured person loses the ability to work and requires regular care, compensation must also be paid for reasonable costs of caring for the injured person.
On the occasion of Tet, the trucks carrying peach blossoms are loaded with bulky goods, which limits visibility and increases the risk of traffic accidents. Therefore, people transporting peach blossoms and kumquats need to be very careful when participating in traffic to minimize the possibility of causing accidents.
