Rectifying the management, use and settlement of the state budget

Prime Minister Pham Minh Chinh has just signed Directive No. 36/CT-TTg dated October 3, 2024 on the implementation of Resolution No. 132/2024/QH15 dated June 24, 2024 of the National Assembly on supplementing the state budget revenue estimate for 2022 and approving the state budget settlement for 2022.

The Directive stated that the National Assembly issued Resolution No. 132/2024/QH15 on supplementing the state budget revenue estimate for 2022 and approving the state budget finalization for 2022; accordingly, the National Assembly highly appreciated the Government's efforts in resolutely directing the synchronous and timely implementation of socio-economic development solutions and rectifying and strengthening discipline and order in compliance with laws on finance and state budget; thereby, state budget revenue and expenditure management was strengthened, state budget revenue exceeded the estimate, state budget expenditure was economical, the proportion of regular expenditure was reduced, and investment expenditure was increased; public debt indicators decreased in proportion to GDP and were within the allowable limit; the national credit rating was raised.

However, the National Assembly also pointed out a number of shortcomings and limitations in the observance of discipline, order, and implementation of legal regulations and Resolutions of the National Assembly on the preparation and implementation of estimates and final settlement of the state budget.

To enhance discipline in state finance and budget management, the Prime Minister requests Ministers, Heads of ministerial-level agencies, Government agencies, other central agencies (ministries, central agencies), Chairmen of People's Committees of provinces and centrally run cities (localities) to continue to resolutely and synchronously implement the required contents in the work of preparing, implementing, and implementing state budget estimates and finalization as stated in Directive No. 22/CT-TTg dated June 23, 2023 of the Prime Minister on rectifying and strengthening discipline in compliance with laws on state finance and budget.

Thoroughly save regular expenses to increase development investment spending.

At the same time, to rectify and strengthen discipline in the implementation of laws on management, use and settlement of the state budget, the Prime Minister requested ministries, central and local agencies to rectify and overcome shortcomings and limitations in the establishment, management and use of the state budget. Continue to focus on forecasting and making estimates of state budget revenue and expenditure close to reality. Make estimates of state budget expenditures to ensure that they are consistent with requirements and implementation capabilities to mobilize and effectively use state budget resources. Thoroughly save on regular expenditures to increase development investment expenditures.

Do not let new debts arise in basic construction. Review and accurately determine the amount of outstanding debts in basic construction using state budget capital, send them to the Ministry of Planning and Investment and the Ministry of Finance before January 1, 2025 for synthesis and reporting to competent authorities.

Strictly manage expenditures transferred from the state budget. Review, cancel, and completely recover expenditures used in violation of regulations or past the disbursement period. Report in detail the expenditures transferred from the 2023 budget to 2024 according to the provisions of Clause 3, Article 64 of the State Budget Law.

Report on unused salary policy reform resources of each ministry, central agency, and locality as of December 31, 2023. Promote thrift practice, combat waste, prevent and combat corruption and negativity. Strengthen inspection and examination work, enhance the responsibility of leaders in budget preparation, management, and use of the state budget to ensure compliance with the provisions of the law on the state budget.

Clarify the causes and responsibilities of leaders, collectives and individuals who do not comply with legal regulations in preparing and implementing budget estimates; prepare and submit the 2022 state budget settlement report later than the prescribed deadline. On that basis, review collectives and individuals who have violated.

Clarifying the responsibilities of organizations and individuals who are late in reporting on the adjustment of the 2022 state budget settlement

Regarding the implementation of the conclusions and recommendations of the State Audit, the Prime Minister requested ministries, central and local agencies to review the conclusions and recommendations of the State Audit on the state budget settlement of the year 2022 and earlier for full implementation. In case of force majeure, the conclusions and recommendations of the State Audit cannot be implemented, a report must be submitted to the competent authority for consideration and decision.

Synthesize the report on the implementation results of the conclusions and recommendations of the State Audit on the state budget settlement for fiscal year 2022 and previous years and send it to the Ministry of Finance together with the State budget settlement report for fiscal year 2023 as prescribed in Clause a, Point 7, Directive No. 22/CT-TTg.

The Ministry of Education and Training, Hanoi National University and the People's Committees of the provinces: Bac Giang, Lai Chau, Thai Binh, Nam Dinh, Ninh Binh, Quang Ngai, Khanh Hoa, Binh Thuan, Kon Tum, Ba Ria - Vung Tau, Ben Tre, Vinh Long clarify the responsibilities of organizations and individuals who are slow to report to competent authorities to adjust the 2022 state budget settlement.

Check and review regular expenditures for equipment procurement activities of the Project to enhance scientific and technological research capacity, strictly handle according to the provisions of law if violations are detected. Report implementation results together with the 2023 state budget settlement report.

Closely evaluate the progress of state budget revenue and expenditure to organize the issuance of government bonds to ensure savings and efficiency.

The Prime Minister assigned the Ministry of Finance to closely monitor and evaluate the progress of state budget revenue and expenditure (including transferred revenue and expenditure) to organize the issuance of government bonds to ensure savings and efficiency. Strictly manage loans and repayment of principal and interest on loans, control state budget deficit and public debt to ensure national financial security and macroeconomic stability.

Urgently study, amend and supplement the State Budget Law and related laws to shorten the process and time for annual state budget settlement as required in the National Assembly's Resolutions.

The Ministry of Finance shall preside over and urge ministries, central and local agencies to report on the implementation results of the State Audit's recommendations; synthesize a general report on the implementation results of the State Audit's recommendations to submit to the Government and the National Assembly together with the 2023 state budget settlement report as prescribed.

The Ministry of Planning and Investment shall synthesize and report to the National Assembly on the handling of outstanding debts for basic construction of state budget capital according to the provisions of the Law on Public Investment of ministries, central and local agencies as of December 31, 2022, and the debts arising and accruing as of December 31, 2023 and December 31, 2024.
