Rectifying the provision of out-of-hospital emergency transport services

Regarding the incident in which a Facebook account accused Khanh Hoa Provincial General Hospital of being involved in emergency transportation services outside the hospital (Khanh Hoa Newspaper reported on April 7), the Department of Health recently issued a document directing relevant units to coordinate with the provincial health sector to rectify the provision of emergency transportation services outside the hospital.

On April 10, specialist doctor II Trinh Ngoc Hiep - Deputy Director of the Department of Health said that after receiving the request letter, petition from the Provincial General Hospital and some information from the press and media, the Department of Health has sent a report to the Provincial People's Committee. Currently, after reviewing, there are 4 facilities in the province that have been licensed to provide emergency transportation services outside the hospital, including: Emergency Center 115 - Provincial General Hospital; Vinmec Nha Trang International General Hospital; Tin Duc General Clinic (Nha Trang City); Dai Duong One Member Co., Ltd. (address 27 Le Dai Hanh, Nha Trang City). Based on the archived records, up to now, the Department of Health has not licensed any facility named Thu Huyen to provide emergency transportation services outside the hospital. The provision of medical-related services in any form, even charitable activities, must comply with the provisions of current laws. Providing medical services without having the relevant licenses is a violation of the law and can cause serious danger to patients and their families when transporting emergency patients.

Also related to this issue, on April 8, the Department of Health issued Official Dispatch No. 1518 requesting emergency transport units outside the hospital, medical examination and treatment facilities that provide emergency care and transport patients outside the hospital to seriously review the operating conditions according to Article 56, Decree 96 (issued on December 30, 2023) of the Government, stipulating and guiding legal procedures and necessary conditions so that units providing emergency transport services know and complete legal documents to apply for an operating license. Specifically, the facility must complete the conditions according to regulations, submit the documents to the Department of Health to be granted an operating license according to the appropriate corresponding types. Units that have been granted an operating license need to urgently review the necessary conditions to ensure that they maintain all conditions in accordance with regulations.

Regarding the provision of out-of-hospital patient transportation services at the Provincial General Hospital, Dr. Phan Huu Chinh - Director of the Provincial General Hospital said that currently, the unit has 3 ambulances, only providing patient support activities when accidents and mass disasters occur in the province; providing free support for seriously ill patients in difficult circumstances, ethnic minorities treated at the Provincial General Hospital to return home or after stable treatment to lower-level medical facilities in the province. In order to meet the needs of patients for out-of-province patient transportation services, in 2022, the hospital plans to cooperate with a unit with sufficient capacity to provide the above services. In May 2022, the hospital conducted a public auction and completed all relevant legal documents. The winning bidder is Dai Duong One Member Co., Ltd., which has been granted a license to operate in the emergency and out-of-hospital transportation sector by the Department of Health (license number 00643/KH-GPHD). Before signing the contract, the Provincial General Hospital announced the public auction on the mass media. Transport units wishing to bid to participate in the transportation of patients transferred to other hospitals must have full licenses from the Department of Health according to regulations. The hospital has regulations that the patient's right to choose to rent a vehicle for transfer is the patient's right. However, if the patient rents a vehicle that has not been granted an operating license and does not meet the prescribed conditions for emergency and out-of-hospital transportation, the hospital's medical staff will not be allowed to accompany them.

Currently, the contents of the accusations against the Provincial General Hospital in the related case are being clarified and handled by the authorities according to regulations.
