Continuing the working program of the 6th Session, this morning, November 3, the National Assembly discussed in the hall a number of contents with different opinions of the draft Land Law (amended).
Speaking at the debate on the draft Law on Land (amended) at the meeting hall, National Assembly delegate Dang Hong Sy - National Assembly Delegation of Binh Thuan province expressed his disagreement with delegate Nguyen Huu Chinh - National Assembly Delegate of Hanoi City on the transfer of rice-growing land. According to delegate Chinh, individuals who do not directly produce agriculture but receive the transfer of rice-growing land, except in the case of inheritance, must establish an economic organization and have a land use plan; delegate Dang Hong Sy disagrees and does not agree with this viewpoint as well as options 1 and 3 in Article 45 of the draft Law.
Explaining this content, according to delegate Dang Hong Sy, this does not ensure the equal rights of citizens in accessing land resources, which is stipulated in Article 23 of the draft Law. On the other hand, in reality, there are many cases where there is no need for agricultural production but there is still a need to use rice land, for example, buying rice land to produce rice within the scope of family consumption; the main thing is that the State must properly manage the purpose of land use according to the planning. Therefore, delegate Dang Hong Sy believes that citizens' rights in accessing land resources should not be limited, the delegate suggests that it should be kept as in the draft Law presented at the 5th session.
Commenting on the draft Land Law (amended), delegate Dang Hong Sy expressed his concern for commune-level civil servants, who are currently holding too many jobs such as construction, rural, urban and environmental. According to the delegate, voters have expressed their concerns about this issue at voter meetings; therefore, the delegate suggested that Article 22 should clearly state that for commune-level land officials, a specialized person must be assigned, and not hold other jobs such as urban, rural, environmental, etc.
Previously, delegate Nguyen Huu Chinh - National Assembly delegate of Hanoi City gave his opinion on expanding the subjects who are eligible to receive the transfer and donation of the right to use rice-growing land in Clause 7, Article 45. Currently, there are 2 options. Delegate Nguyen Huu Chinh agreed with option 1. The delegate said that in order to meet the conditions for receiving the transfer, individuals who are not directly involved in production must have a land use plan and plan to use rice-growing land, which is suitable for current conditions, avoiding the situation of not being able to manage the land fund...
