Get opinions on blood alcohol concentration, breath
The leaders of the Department of Medical Examination and Treatment Management (Ministry of Health) have just sent an official dispatch to experts and a number of specialized units, requesting research and proposals on the issue of alcohol concentration in the blood or breath of drivers of vehicles (generally referred to as drivers).
There are no regulations in the country on natural alcohol concentration in blood and breath for drivers.
The proposal is based on medical aspects such as: alcohol concentration detected in the body not due to alcohol or beer use; alcohol concentration limit in blood or breath of vehicle drivers.
The Department of Medical Examination and Treatment Management requests experts and units to send proposals for regulatory content to the Department of Medical Examination and Treatment Management before February 20, for synthesis and reporting to the leaders of the Ministry of Health.
An expert from the Department of Medical Examination and Treatment Management said that proposals from experts and professional units are the basis for the department to research and propose regulations on alcohol concentration in blood or breath for drivers.
Recently, representatives of the Ministry of Health also had a meeting with the Ministry of Public Security on a number of issues related to alcohol concentration regulations for drivers. This issue will be discussed by the two ministries and related agencies in the near future.
Voters propose to regulate minimum alcohol concentration, what does the Ministry of Transport say?
There are no regulations on natural alcohol concentration.
Regarding current regulations on alcohol concentration for drivers, an expert from the Ministry of Health said that the 2008 Road Traffic Law prohibits driving cars, tractors, and specialized motorbikes on the road while having alcohol concentration in the blood or breath.
This regulation has been applied consistently to drivers of cars, tractors, and specialized motorbikes for 10 years, before the Law on Prevention of Harmful Effects of Alcohol and Beer was issued. The Law on Prevention of Harmful Effects of Alcohol and Beer has inherited this regulation and expanded it to drivers of motorbikes and other means of transport.
Currently, legal documents do not have regulations on natural alcohol in the body.
Regarding the alcohol concentration threshold, Decision No. 320/QD-BYT dated January 23, 2014 of the Minister of Health stipulates the quantification of ethanol (quantification of alcohol concentration) in the blood, in section 60 of this decision.
Accordingly, at point 4 "result assessment" it is stated: the value is usually below 10.9 mmol/liter (equivalent to 50 mg/100 ml).
Ethanol from 10.9 - 21.7 mmol/l: symptoms of red face, vomiting, slow reflexes, decreased sensitivity; 21.7 mmol/l: symptoms of central nervous system depression; concentration 86.8 mmol/l: can be life-threatening.
The above content in Decision No. 320/QD-BYT is a classification of alcohol concentration levels and thresholds corresponding to the level of manifestation of health and life effects, according to medical expertise. This does not mean that the understanding that blood alcohol levels below 0.5 mg/ml are allowed to be considered natural alcohol in the body.
A medical expert said that some medical products used for patients may contain alcohol, causing people who do not drink alcohol or beer to still have a low alcohol concentration index, in situations where alcohol testing and assessment of alcohol concentration are required. Therefore, it is necessary to consider regulations on blood and breath alcohol concentration.
However, this needs to be evaluated very closely on a scientific and medical basis, to ensure safety for drivers and other road users; social security and order; and strict enforcement of regulations on preventing the harmful effects of alcohol and beer.
