The Ministry of Education and Training has just introduced a draft circular regulating the transparency in the activities of educational institutions (hereinafter referred to as schools) in the national education system. If issued, this circular will replace Circular 36/2017/TT-BGDDT issued by the Ministry of Education and Training in 2017. With the new draft circular, the requirements for information disclosure with schools are still guaranteed, but administrative procedures will be significantly reduced.
The new draft circular replacing Circular 36 still requires ensuring "three public disclosures", including financial disclosure.
The public content stipulated in the new draft circular is comprehensive (mainly based on the provisions of the Law on Education and Decree 99 guiding a number of articles of the Law on Higher Education), not re-stipulating but can refer to related regulations.
Another new point of the draft circular is the addition of regulations on the content of annual reports. The annual report is not a summary of public information of the circular but is one of the forms of public disclosure that shows a panoramic picture of the school's performance results in each year. Through the public data in the annual report, the information has comparative value for the following year compared to the previous year.
In particular, the new draft circular is restructured to minimize the number of mandatory forms that schools must declare. In Circular 36/2017/TT-BGDDT, schools must declare according to 21 appendix forms, while in the new draft circular, they only have to declare according to 2 appendix forms. Appendix 1 form is for preschools, general schools, and continuing education schools; Appendix 2 form is for universities and pedagogical colleges. In essence, each school only has to declare according to one form, which is the annual report on publicizing the activities of educational institutions.
Speaking to Thanh Nien , a leader of the Department of Education Quality Management, Ministry of Education and Training, said that reducing this form is to avoid overlap in the implementation of public disclosure by schools. Currently, basic information disclosed according to regulations is updated on the industry database. The new draft circular only stipulates the content, method, time of disclosure and principles of disclosure so that schools can proactively build information by topic to be compatible with the structure of each school's electronic information page.
The disclosure requirements remain the same as current ones, including the following groups of contents: disclosure of commitment to education quality and actual education quality; disclosure of conditions for ensuring education quality; and financial disclosure.
