The Ministry of Public Security has just announced the draft Law on Road Traffic Order and Safety to solicit public comments. This draft law was drafted by the Ministry of Public Security, based on a section of the 2008 Road Traffic Law.
According to the proposal of the Ministry of Public Security, if the information has been synchronized into the electronic identification account, people do not need to carry their driver's license when participating in traffic.
No need to carry driver's license if integrated
According to the Ministry of Public Security, compared to the 2008 Road Traffic Law, the draft Law on Road Traffic Order and Safety adds many regulations, aiming to meet the requirements of administrative reform, application of modern science and technology, and serving the people.
Of these, Article 38 of the draft specifies the conditions for drivers participating in road traffic.
Similar to current regulations, the draft states that drivers participating in road traffic must have a driving license appropriate to the type of vehicle they are driving. When participating in traffic, drivers must carry the following documents: vehicle registration certificate; driving license appropriate to the type of vehicle they are driving; certificate of technical safety inspection and environmental protection for motor vehicles according to the provisions of law; certificate of compulsory civil liability insurance for motor vehicle owners.
The new point of the draft is that the Ministry of Public Security proposes that in case the information of the above documents has been synchronized into the electronic identification account, the driver will no longer have to carry it when participating in traffic.
Similarly, drivers of specialized motorbikes must carry the following documents when participating in traffic: vehicle registration certificate; driving license or certificate or certificate of training in road traffic law; certificate of technical safety inspection and environmental protection for specialized motorbikes according to the provisions of law; certificate of compulsory civil liability insurance according to the provisions of law.
In case the information of the above documents has been synchronized into the electronic identification account, the vehicle driver may not need to carry them.
The draft law, drafted by the Ministry of Public Security, makes many new proposals related to driving licenses.
Traffic police are not allowed to ask for a driver's license if it is integrated.
According to Decree 59/2022, an electronic identification account is a collection of usernames, passwords or other forms of authentication created by an electronic identification and authentication management agency. Vietnamese citizens aged 14 and over are granted electronic identification accounts.
This is also the “key” to exploiting data on citizens’ electronic identities (identification number, full name, date of birth, gender, portrait, fingerprints) or integrated information. To use electronic identification accounts, citizens and agencies and organizations can use the VneID application (developed by the Ministry of Public Security).
There are 2 levels of electronic identification accounts. With level 1, people only need a chip-embedded ID card, use a mobile device to download and install the VnelD application according to the instructions.
At level 2, people need to go to the commune-level police headquarters or the place where the CCCD card issuance procedure is carried out. Here, police officers will integrate information of various documents (according to people's needs) into the electronic identification account.
Thus, according to the proposal of the Ministry of Public Security, if people already have a level 2 electronic identification account and have integrated driver's license information, when driving on the road, they will no longer need to carry a traditional driver's license, but can use the VneID application to present it when requested by the authorities.
To clarify this, Clause 5, Article 54 of the draft states: when patrolling and controlling, in case the vehicle and driver's document information has been synchronized into the electronic identification account, the traffic police will control that document information on the electronic identification account.
According to data from the Department of Administrative Police for Social Order (Ministry of Public Security), as of May, the Ministry of Public Security has issued more than 80 million chip-embedded CCCD cards and received 37.1 million electronic identification applications; of which 16.5 million electronic identification accounts have been activated.
