(HNMO) - Regarding people who are granted citizen identification cards (CCCD), the draft Law supplements regulations on management and issuance of cards for people under 14 years old and issuance of identity certificates for people of Vietnamese origin to ensure their legitimate rights and interests and serve state management work; promote the value and utility of identity cards in the activities of digital government and digital society.
However, card issuance for people under 14 years old will be done according to demand, while for people 14 years old and above it is mandatory.
On the afternoon of June 2, continuing the program of the fifth session of the 15th National Assembly, under the direction of Vice Chairman of the National Assembly Tran Quang Phuong, Politburo member, General - Minister of Public Security To Lam, authorized by the Prime Minister, presented the Report on the draft Law on Citizen Identification (amended).
According to Minister To Lam, to date, the Ministry of Public Security has issued nearly 80 million CCCD cards to eligible people. The National Population Database has been connected to 13 ministries, branches and 63 localities; the connection and exploitation of the National Population Database serves many activities.
The draft Law on CCCD consists of 7 chapters and 46 articles, serving the settlement of administrative procedures and provision of online public services; serving economic and social development; serving digital citizens; perfecting the ecosystem serving connection, exploitation, supplementation and enrichment of population data; serving the direction and administration of leaders at all levels.
Regarding the content shown on the ID card, the draft Law amends and supplements in the direction of removing fingerprints; amending regulations on information on ID card number, hometown, permanent residence, signature of the card issuer to personal identification number, place of birth registration, place of residence...
“The above changes and improvements will make it more convenient for people to use their ID cards, limit the need to issue new ID cards, and ensure people's privacy. People's basic identification information will be stored, exploited, and used through the electronic chip on the ID card. Cards that have been issued and are still valid will not be affected by this regulation,” Minister To Lam informed.
Regarding the procedures for issuing ID cards, the draft Law has been amended and supplemented in the direction of stipulating the separation of procedures for issuing cards for people under 14 years old and people 14 years old and older. Accordingly, for people 14 years old and older, the basic procedures remain unchanged. For people under 6 years old, the parents or guardians carry out the card issuance procedures online on the public service portal. In the case of people 6 years old and older, the parents or guardians must take that person to the ID management agency to collect identification characteristics and biometric information like people 14 years old and older when carrying out the ID card issuance procedures.
Presenting the Report on the review of the revised Law on Citizen Identification Cards, Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi said that in order for the development and promulgation of the Law to be rigorous, effective and in line with reality, the Government is requested to continue to promote propaganda work, invest in developing synchronous digital infrastructure, promptly complete the application of electronic identification accounts, connect and share information in the National Population Database, and maximize the effectiveness of the National Population Database and the Identity Card Database.
Regarding identity certificates and management of people of Vietnamese origin (Article 7), the National Defense and Security Committee agreed with the addition of the subject of application to people of Vietnamese origin whose nationality has not been determined and believed that granting identity certificates to people of Vietnamese origin would open up a solution for a group of people of Vietnamese origin who wish to have a type of identification document, helping them stabilize their lives, have jobs, send their children to school, ensure their rights in civil transactions, in accordance with the policies of the Party and the State, and meet the requirements of state management.
According to Mr. Le Tan Toi, there are opinions suggesting to study specific regulations in the draft Law on criteria and conditions for granting identity certificates; management of people of Vietnamese origin; and competent authorities to manage this subject. At the same time, there are opinions suggesting to only stipulate some basic information shown on identity certificates to ensure suitability, feasibility and convenience in implementation, other information fields can be managed and exploited on the Database.
Regarding the people who are granted ID cards (Article 20), Mr. Le Tan Toi said that the National Defense and Security Committee basically agreed with the provisions of this Article to promote the exploitation and use of the National Population Database and the ID Database. However, there were opinions suggesting considering the regulation that the subjects who are granted ID cards are people under 14 years old because it is believed that the need to use ID cards of this group of subjects is very low.
