Basically agreeing with the Government's proposal to allow the separation of compensation, support, resettlement, and site clearance into independent projects for all project groups, the National Assembly delegate suggested that it is necessary to strictly regulate the articles and clauses to ensure that compensation and resettlement work is associated with investment in project completion, avoiding waste.

Afternoon of October 29, discussion in group about the project Regarding the Law on Public Investment (amended), most opinions agree on the necessity of amending the Law and believe that the provisions in the draft will contribute to fundamentally removing the shortcomings, limitations, obstacles, and bottlenecks arising in the implementation of the Law on Public Investment in recent times.

Contribute to overcoming the situation of prolonged investment and slow disbursement

In the draft revised law, the Government proposes to separate compensation, support, resettlement, and site clearance into independent projects for all project groups (including group B and C projects).

The separation of site clearance for projects must be consistent with planning and plans, and the source of capital must be determined when approving the project investment policy; thereby limiting widespread site clearance.

Agreeing with the separation of compensation, support, resettlement, and site clearance to overcome the situation of prolonged investment and slow disbursement, National Assembly delegate Tran Van Tien (Vinh Phuc delegation) suggested that it is necessary to specify the completion time for both site clearance and construction investment projects.

Or the project is divided into 2 phases, in which phase 1 is to carry out site clearance work, phase 2 is to carry out the construction investment project.

Delegate Dao Chi Nghia (Can Tho City delegation) cited Clause 1, Article 5 of the draft Law, which stipulates: “In cases where it is truly necessary to separate compensation, resettlement support, and site clearance into independent projects, the National Assembly shall consider and decide on important national projects; for group A, group B, and group C projects, the competent authority deciding on the project investment policy shall consider and decide according to its authority…”.

The delegate requested the drafting agency to clarify the content of "really necessary cases" so that localities can unify in implementing the Law.

Delegate Nguyen Van Huy (Thai Binh delegation) basically agreed with the Government's proposal to allow the separation of compensation and resettlement work into independent component projects within the overall project for all project groups.

However, delegates said that it is necessary to strictly regulate the articles and clauses to ensure that compensation and resettlement work is associated with investment to complete the project, not to waste money, and the total time for arranging capital to implement two independent component projects to complete the programs and projects must not exceed the regulations on project implementation time.

Carefully consider the regulations on using regular expenditure sources for project establishment and appraisal.

Regarding the costs of establishing, monitoring, checking, evaluating, and inspecting public investment plans, programs, and projects, Article 16 of the draft Law stipulates the use of regular expenditure sources of agencies and units to implement the costs of establishing, appraising, monitoring, checking, evaluating, and inspecting public investment plans, programs, and projects.

According to Vice Chairwoman of the National Assembly Nguyen Thi Thanh, such regulations aim to expand the scope of capital use to prepare public investment for projects, creating flexibility for ministries, agencies and localities to speed up the progress of infrastructure development projects, especially projects of national strategic nature or important local projects.

However, if not strictly regulated, it will affect other spending sources in the context of the Government continuing to have a policy of reducing regular spending. Therefore, the Vice Chairman of the National Assembly suggested considering and explaining the reason for amending this content.

If amended in the above direction, it is necessary to have very strict regulations and only apply to projects that are truly urgent, feasible and have a clear impact on promoting socio-economic development, the Vice Chairman of the National Assembly noted.

Delegate Duong Van Phuoc (Quang Nam delegation) also suggested that this regulation should be considered, because the regulation on the use of regular expenditure sources may affect the implementation of other tasks from regular expenditure sources of agencies and units.

Agreeing with the addition of regular expenditure sources for the above-mentioned public investment activities to remove practical difficulties, delegate Nguyen Danh Tu (Kien Giang delegation) suggested that some expenditure contents need to be carefully considered, because the scope of expenditure is relatively wide, if not strictly regulated, it could lead to an increase in the scale of regular expenditure, affecting the implementation of the general policy of reducing regular expenditure and increasing development investment expenditure.

“Many contents can lead to large expenditure sources such as project establishment, appraisal and decision costs; approval costs for public investment projects using ODA capital, preferential loans from foreign donors... These expenditure contents use large expenditure sources. If there is no clear separation in the use of investment expenditure sources and regular expenditure sources for these tasks, it can lead to increased regular expenditures,” delegate Tu noted.
