Continuing the 7th Session Program, on June 19, the National Assembly listened to the Presentation and Verification Report on the draft Law on Fire Prevention, Fire Fighting and Rescue (PCCC and CNCH).
Ensuring a full legal basis in fire prevention and fighting and search and rescue activities
Authorized by the Prime Minister, presenting the Report on the draft Law on Fire Prevention, Fire Fighting and Rescue, Minister of Public Security Luong Tam Quang emphasized the necessity of promulgating the Law to institutionalize the Party's viewpoints, guidelines and policies on strengthening leadership and management of fire prevention and fighting and rescue work; ensuring a legal basis in accordance with the provisions of the Constitution for the Fire Prevention and Rescue Police force to perform its duties, ensuring the legitimate rights and interests of the people, protecting human rights and civil rights.

The promulgation of the Law also meets objective practical requirements and overcomes limitations, difficulties and inadequacies of current laws, ensuring consistency and unity of the legal system; and strengthening state management of fire prevention and fighting in the new situation.
The Draft Law consists of 09 chapters and 65 articles. Specifically: Chapter I on general provisions includes 11 articles regulating the scope of regulation for fire prevention and fighting and search and rescue activities; Chapter II on fire prevention includes 09 articles; Chapter III on fire fighting includes 12 articles; Chapter IV on search and rescue includes 07 articles; Chapter V on construction, arrangement of forces, and tasks of fire prevention and fighting and search and rescue forces includes 06 articles; Chapter VI on fire prevention and fighting and search and rescue means includes 04 articles; Chapter VII on ensuring conditions for fire prevention and fighting and search and rescue activities includes 09 articles; Chapter VIII on state management of fire prevention and fighting and search and rescue includes 04 articles; Chapter IX on implementation provisions includes 03 articles.
Ensuring consistency and unity in the legal system
Reporting on the review of this Law project, Chairman of the National Defense and Security Committee Le Tan Toi agreed on the necessity of promulgating the Law to fully institutionalize the Party's policies and guidelines on fire prevention and fighting and search and rescue; legalize current regulations and supplement full and comprehensive regulations on search and rescue activities that the fire prevention and fighting and search and rescue forces are assigned to undertake; promptly overcome existing limitations and shortcomings, ensure the consistency and unity of the legal system and strengthen state management of fire prevention and fighting and search and rescue in the new situation.

The National Defense and Security Committee basically agrees with the structure of the draft Law, and at the same time proposes to supplement more fully and specifically the provisions on fire prevention and fighting activities; to continue to review and arrange to ensure the balance and logic between the chapters and articles of the draft Law, in accordance with the objectives of building the Law; to propose to continue to research and institutionalize more fully, comprehensively and specifically in this draft Law the guidelines, policies and guidelines of the Party and State on fire prevention and fighting and fire prevention and fighting activities, and to carefully review related Laws to ensure consistency and unity in the legal system.
Regarding fire prevention and fighting and search and rescue planning, the National Defense and Security Committee proposed that the Government base on the Party's policy, combine practical summaries, and study and supplement regulations on fire prevention and fighting infrastructure planning in the draft Law to stipulate specific contents and requirements for fire prevention and fighting infrastructure planning and the relationship with national sectoral planning, regional planning, and provincial planning in accordance with the law on planning to ensure consistency in ensuring fire prevention and fighting and search and rescue conditions.
Supplement more specific regulations on CNCH activities
Regarding the State's policy on fire prevention and fighting and search and rescue (Article 4, Chapter I), there are opinions suggesting to study and supplement regulations on policies to disseminate knowledge and skills on fire prevention and fighting and search and rescue; training and drills on fire prevention and fighting and search and rescue; policies on ensuring investment and allocating resources for fire prevention and fighting and search and rescue in accordance with the socio-economic development situation of each locality and region; policies to protect and support vulnerable groups in fire prevention and fighting and search and rescue activities; policies to mobilize all classes of people and forces to participate in fire prevention and fighting and search and rescue; specific policies on socialization of fire prevention and fighting and search and rescue.
Regarding fire prevention activities (Chapter II), the National Defense and Security Committee believes that the draft Law is basically consistent with the position and role of the subjects in fire prevention and fighting work, meeting practical requirements. However, it is recommended to continue studying and clarifying fire prevention and fighting requirements for each type of planning in Clause 1, Article 13 to have fire prevention and fighting solutions and designs suitable for each type of planning; more clearly defining the method of applying standards and conditions for each type of construction and project; clearly classifying to what extent renovation works require fire prevention and fighting solutions and designs; reviewing and unifying regulations related to authority, responsibility, order, procedures, and coordination in the examination, appraisal, acceptance, and inspection of fire prevention and fighting acceptance results, etc.
Regarding fire fighting activities (Chapter III), the National Defense and Security Committee proposed to study and supplement the provisions in Article 26 to clarify the responsibility for paying for water usage costs from the complete centralized water supply system when practicing fire fighting plans of the Public Security agency and serving fire fighting work; clarify the arrangement of fire hydrants on the complete centralized water supply network according to standards and technical regulations on fire prevention and fighting or standards and technical regulations on water supply.
Regarding search and rescue activities (Chapter IV), some opinions suggested studying and supplementing more fully and specifically the regulations on search and rescue activities to increase the transparency of the Law, ensuring a clear distinction with civil defense activities, natural disaster prevention and control activities according to current laws; considering regulations on search and rescue in fires; regulations on coordination in search and rescue activities...
