ANTD.VN - The project to build an urban and service area in the West of Cho town, subdivision A - area 3 (Kim Do Policity) invested by Hung Ngan Housing and Trade Investment Joint Stock Company has just been pointed out by the Inspectorate of Bac Ninh province for a series of shortcomings and violations.
Many limitations from planning to investment and compensation
The Inspectorate of Bac Ninh province has just concluded the inspection of the project to build an urban and service area in the west of Cho town, subdivision A - area 3 (Kim Do Policity project) to repay counterpart funds for the investment project to build, renovate and upgrade TL286 from Cho town to Do Lo bridge under the BT (investment - transfer) form in Yen Phu commune, Yen Phong district. The project is invested by Hung Ngan Housing and Trade Investment Joint Stock Company (Hung Ngan Company).
The conclusion of the Inspectorate of Bac Ninh province stated that the project to build an urban and service area in the west of Cho town, subdivision A - area 3, was approved by the People's Committee of Bac Ninh province with an investment policy decision with an area of 75 hectares, a total investment of more than 3,569 billion VND, and construction progress until 2025.
According to the Inspectorate of Bac Ninh province, the project has many limitations in planning, investment, payment of compensation for site clearance, construction; implementation of financial obligations on land, business conditions, business results, and real estate transfer.

Regarding project planning, the Department of Construction issued a detailed 1/500 plan that is not yet consistent and uniform in recording the number of floors of townhouses and villas.
Regarding investment, the project scale according to the Prime Minister's decision (246.36ha) and according to the decision of the Bac Ninh Provincial People's Committee (75ha) are inconsistent. The Bac Ninh Provincial People's Committee needs to clarify this matter. In case of adjusting the project scale, the Provincial People's Committee is responsible for reporting to the Prime Minister for consideration and adjustment.
Hung Ngan Company invested in building technical infrastructure for the flower garden and square projects behind schedule compared to the investment policy approved by the Provincial People's Committee.
In addition, the investor built 92/509 townhouses (4 floors + 1 roof floor) according to the approval of the Department of Construction, but it was not in accordance with the investment policy decision (4-storey townhouses).
Hung Ngan Company is carrying out procedures to adjust the investment policy decision to submit to the competent authority for approval according to the provisions of the law on investment, however, at the time of inspection, the adjustment of the investment policy decision has not been completed.
Regarding the limitations in land acquisition and site clearance, the People's Committee of Yen Phong district approved the support fund for the assets on the land (road embankment land) at 72,000 VND/m3 without the permission of the Chairman of the Provincial People's Committee; has not approved the compensation plan for 8,662m2 of difficult-to-cultivate agricultural land that was acquired by the People's Committee of Yen Phong district from 31 households and the People's Committee of Yen Phu commune (agricultural land area managed by the People's Committee of the commune).

Selling future houses without bank guarantee
In another development, the Compensation and Support Council for Land Acquisition and Site Clearance of Yen Phong District paid the adjusted and supplemented compensation and support costs before the Yen Phong District People's Committee issued the approval decision. The minutes of land and property inventory on land serving the land acquisition and site clearance for project implementation (adjusted and supplemented phase 1) also did not record a specific date.
Regarding construction at the project, the implementing units did not design and did not point out the shortcomings in not designing and constructing access ramps for people with disabilities to use according to regulations; the design and appraisal of adjacent houses (4 floors + 1 roof floor) and villas (3 floors + 1 roof floor) were not consistent with the investment policy decision of the Provincial People's Committee.
The Department of Construction of Bac Ninh approved the model of townhouses and villas, recording the height as the number of floors in the documents approving the urban design models of the project, which is not in accordance with the provisions of the 2014 Construction Law; the number of floors is also not consistent with the construction management regulations according to the detailed planning of the urban and service area west of Cho town, subdivision A.
Hung Ngan Company and related units constructed and installed the height of the railings outside the balconies of the townhouses that did not meet the minimum prescribed height.
Regarding financial obligations, the Department of Transport of Bac Ninh has not yet fully implemented the direction of the Chairman of the People's Committee of Bac Ninh province in settling the interest on capital mobilization loans of Hung Ngan Company.
On the other hand, the investor has not yet paid the State budget nearly 1.8 billion VND (late payment of land use fees) according to the announcement of the Tu Son - Yen Phong Regional Tax Department.
In addition, Hung Ngan Company has not signed a guarantee contract with a commercial bank with sufficient capacity to guarantee the investor's financial obligations to customers in the sale, lease, and purchase of future housing, violating the provisions of the 2014 Law on Real Estate Business.
With the above limitations, the Inspectorate of Bac Ninh province recommends that the Department of Construction inspect, review and consider handling administrative violations against Hung Ngan Company in not signing a guarantee contract with a commercial bank with sufficient capacity to guarantee the financial obligations of the Investor to customers in the sale, lease and purchase of future housing.
The Inspectorate of Bac Ninh province also requested the People's Committee of Yen Phong district to organize inspection, review and consider handling of administrative violations in construction of Hung Ngan Company as pointed out by the Inspection Team.
At the same time, the Provincial Inspectorate requested Hung Ngan Company to contact the Department of Planning and Investment and the People's Committee of Yen Phong district to complete the dossier and procedures for adjusting the investment policy decision to submit to the competent authority for approval according to regulations.
In particular, the Inspectorate of Bac Ninh province requires Hung Ngan Company to only transfer project land lots and trade in future housing when it meets all conditions and has the consent of the competent State management agency.
Fully perform financial obligations on land, VAT, corporate income tax... in the future housing business activities of the project to the State budget according to regulations.
