On June 5, 2024, the Government issued Decree No. 60/2024/ND-CP on market development and management. This Decree takes effect from August 1, 2024. In order to fully and synchronously implement regulations on market development and management in accordance with the socio-economic development conditions of the province; promote the effective operation of markets in the province, the People's Committee of Bac Kan province has issued a document directing departments, branches and localities to strictly implement regulations on market development and management in the province according to their assigned functions and tasks.
In particular, the Department of Industry and Trade is assigned to: Preside over and coordinate with departments, branches, People's Committees of districts and cities; People's Committees of communes, wards and towns; market management organizations in the province to propagate, disseminate, guide and implement Decree No. 60/2024/ND-CP to ensure practicality, efficiency and timeliness. At the same time, effectively implement the Plan to implement the Bac Kan Provincial Planning for the period 2021 - 2030, with a vision to 2050 for the development and management of the market system in the province.
At the same time, advise on policies, measures and solutions to mobilize and exploit resources to develop the market network in the province; policies and measures to develop night markets, community markets, markets with historical, cultural and architectural landscape values suitable to the actual conditions of the province, ensuring compliance with regulations.
The Department of Industry and Trade is also assigned to preside over and coordinate with departments, branches and localities to advise the Provincial People's Committee to issue documents on market management and development such as: Decision on decentralization of market management in the province to the People's Committees of districts and cities; People's Committees of communes, wards and towns in accordance with the actual situation in the localities and current regulations; Plan for market development in the province to invest in building new, renovating and upgrading markets; calling for investment in developing the market system in the province and in accordance with the socio-economic development conditions of the province; Procedures for converting management, business and exploitation models of markets in the province; Model regulations for markets in the province to unify the development of market regulations and apply to all markets in the area; Instructions and regulations on the management of business locations in markets in the province to ensure social security, food hygiene and safety, security and order in the markets.
In addition, the Department of Industry and Trade is also assigned to organize training and professional development on market development and management under the guidance of the Ministry of Industry and Trade. At the same time, it conducts inspections and supervision of the implementation of legal regulations and policies on market development and management according to assigned functions and tasks.

The Department of Finance is assigned to guide the People's Committees at district and commune levels; market management organizations to apply and implement the management regime, calculate depreciation, and amortize market infrastructure assets; and the accounting regime for market infrastructure assets in the province according to the regulations and instructions of the Ministry of Finance.
In addition, coordinate with departments, branches and localities to advise the Provincial People's Committee to implement regulations on management, use and exploitation of market infrastructure assets invested and managed by the State in the province according to regulations and instructions of the Ministry of Finance; build a database on market infrastructure assets invested and managed by the State in the province to serve as a basis for integration into the National Database on Public Assets according to regulations, instructions and directions of the Ministry of Finance and coordinate to deploy and guide the review of market infrastructure assets invested and managed by the State; guide the reporting and declaration of market infrastructure assets in the province.
The Department of Planning and Investment shall preside over and coordinate with relevant agencies and units to carry out activities to promote and attract investment in the construction and development of market networks in the province. Implement guidelines for selecting investors for market construction investment projects in the province according to the guidance of the Ministry of Planning and Investment and relevant legal provisions.
The Department of Construction shall preside over and guide the implementation of contents related to construction standards, norms, and maintenance procedures for market infrastructure assets in the province within the scope of assigned functions and tasks.
The Department of Natural Resources and Environment shall preside over and coordinate with departments, branches and localities to guide and inspect the management and use of land and environmental protection work in markets according to regulations.
The Department of Culture, Sports and Tourism presides over and coordinates with departments, branches and localities in advising on promoting and connecting tourism activities, promoting markets with historical and cultural relic values, architectural landscapes and night markets in the province.
The Department of Home Affairs shall take the lead in advising and guiding the establishment, consolidation, organizational structure, apparatus, and operating regulations of public service units assigned with market infrastructure assets according to regulations.
The Department of Justice coordinates with the Department of Industry and Trade and relevant agencies and units in advising on the promulgation; amendment, supplementation; and abolition of legal documents issued by the Provincial People's Committee related to the market sector in the province.
The Department of Information and Communications coordinates with the Department of Industry and Trade, relevant departments, branches and localities to direct and orient press agencies in the province to promote propaganda and dissemination of the contents of Decree No. 60/2024/ND-CP and relevant legal provisions on markets in the province.
Bac Kan Provincial Police shall preside over and coordinate with departments, branches and localities to implement fire prevention and fighting management; ensure security, order and social safety within the market and surrounding areas; propagate and guide people to strictly comply with legal regulations, actively denounce crimes, ensure network security and order within the market and surrounding areas. At the same time, coordinate with departments, branches and localities to inspect and handle acts of smuggling, trade fraud, trading in prohibited goods, counterfeit goods, poor quality goods, violations of regulations on food hygiene and safety, and the environment in business activities at the market.

The Provincial Market Management Department regularly inspects and controls the market, handles violations of the law on trading in smuggled goods; trading in counterfeit goods, banned goods, goods of unknown origin; violations of the law on quality, measurement, price, food safety; violations of the law on protecting consumer rights at markets in the area.
People's Committees of districts and cities; People's Committees of wards, communes and towns: Proactively implement assigned tasks according to their authority in Decree No. 60/2024/ND-CP for markets in the management area. Review and announce the classification and classification of markets in the area according to management decentralization.
In addition, focus on reviewing, developing plans and organizing the elimination and final handling of spontaneous business locations that are not in accordance with planning, encroaching on corridors and sidewalks, and not ensuring security, order, environmental sanitation, and traffic safety. Closely coordinate with the Department of Industry and Trade and the Department of Finance to implement related tasks.
At the same time, proactively review market infrastructure assets invested and managed by the State in the area; proactively report, declare and update data on market infrastructure assets invested and managed by the State in the area to integrate into the National Database on public assets of the province and the country. Proactively balance state budget capital to invest or support investment capital for market development in the area based on practical situations, urgency, in accordance with the provisions of the law on public investment, state budget and other relevant legal provisions.
People's Committees of districts and cities; People's Committees of wards, communes and towns regularly inspect and supervise the management of market land use, environmental sanitation and food safety in markets; coordinate with district and commune police to inspect fire prevention and fighting. Organize, inspect, supervise the implementation of legal regulations and policies on market development and management and resolve issues related to difficulties, complaints, lawsuits, disputes, and handle violations of the law related to business activities of markets in the area according to the management hierarchy. Review and propose adjustments to the Market Development Plan according to the adjustment period of the Provincial Planning in accordance with the practical situation and socio-economic development of the locality in each period.
According to the People's Committee of Bac Kan province, the synchronous implementation according to the assigned functions and tasks of departments, branches and localities aims to promptly overcome the current shortcomings and inadequacies in market management in the province; ensure that the markets are effective in attracting business and trading activities in the locality; contribute to promoting local socio-economic development.
