2 things drivers may have to retake when their driving license is deducted all points

The Ministry of Public Security has just issued a draft Circular regulating the organization of legal knowledge testing on road traffic order and safety to restore driving license points.

Accordingly, Article 4 of the draft stipulates that the Traffic Police Department (Ministry of Public Security) or the Traffic Police Department of the provincial or municipal police will organize the examinations. The examination content is issued by the Ministry of Transport.

Participants will take a computer-based test to assess their knowledge of road traffic laws. Drivers will also be tested in simulated traffic situations.

Foreigners must have an interpreter when coming for the test. Ethnic minorities may need an interpreter when participating in the test if necessary.

Content of the test of legal knowledge on road traffic order and safety

For the theory test , test takers with A, A1, B1 driving licenses must complete the test in 19 minutes. The test consists of 25 multiple choice questions, each worth 1 point. There is one question that, if answered incorrectly, is considered a failing score. If the test taker receives a failing score, he or she does not meet the requirements.

The required score for A1 grade is from 21/25; for A, B1 grade is from 23/25 points.

Candidates with a class B or C1 driver's license must complete the test in 22 minutes. The test consists of 35 multiple-choice questions, each worth 1 point. One question, if the wrong answer is chosen, is considered a failing score. If the candidate receives a failing score, he or she does not meet the requirements. The result is that a score of 32/35 or higher is considered satisfactory.

Candidates with D1 and C driving licenses must complete the test in 24 minutes. The test consists of 40 multiple-choice questions, each worth 1 point, including 1 question that, if answered incorrectly, will be considered a failing score. If the candidate receives a failing score, he or she does not meet the requirements. The result is that a score of 36/40 or higher is considered a passing score.

Candidates with a D2, D, BE, C1E, CE, D1E, D2E, DE driving license must complete the test in 26 minutes. The test consists of 40 multiple choice questions, each question is worth 1 point, including 1 question that, if the wrong answer is chosen, is considered a failing score. In case of a failing score, the candidate does not meet the requirements. The result is that from 41/45 points or more is satisfactory.

The simulation section consists of 10 written questions, with a time limit of no more than 10 minutes. Each question has a maximum score of 5, a minimum of 1, and the content describes different potential traffic safety situations.

The score achieved by the test taker corresponds to the time of recognizing and identifying a potentially unsafe traffic situation through interaction with a computer with simulation software installed. The result is that a score of 35/50 or higher is satisfactory.

A person with a driving license must pass both the theory and simulation tests. If he fails the theory test, he will not be allowed to take the simulation test. If he passes the theory test but fails the simulation test, the theory test result will be retained for one year. Within 3 days of failing the simulation test, he can register to retake the test.

According to Article 58 of the Law on Road Traffic Order and Safety, a person whose driving license has had all points deducted will not be allowed to drive a vehicle on the road. That driving license will also no longer be valid. After at least 6 months from the date of having all points deducted, the person with a driving license will be allowed to take a test on knowledge of the law on road traffic order and safety.
The Ministry of Public Security has proposed that 189 acts will result in a driving license penalty of 2-12 points. Of these, 28 acts will result in a penalty of 12 points.
