According to this decision, Thuy Ta restaurant in area I of Xuan Huong lake was recognized by the Ministry of Culture and Information as a national scenic spot in Decision 1288-VH/QD dated November 16, 1988. Thus, the place name Thuy Ta restaurant is associated with the structure of the national scenic spot. Therefore, the change of the place name Thuy Ta restaurant is decided by the Ministry of Culture and Information, not under the authority of the People's Committee of Da Lat city.
Because this house and land is part of the national scenic relic of Xuan Huong Lake, it is proposed to lease it in its original state, without expansion, new construction, or additional structures (except in cases of local adjustment of urban design).
The lessee is only allowed to repair, renovate and upgrade the interior space and color of the building (it is recommended to keep the white paint color and restore the wooden doors), and is not allowed to change the shape of the exterior structure of the house. In case of ensuring safety due to building degradation, before major repairs or renovations that affect the load-bearing structure, there must be written consent from the lessor and a construction permit reviewed and granted by the Department of Construction.
The winning bidder for the lease must maintain the current status of the project.
It is known that the area of the house and land of Thuy Ta restaurant is 3,876 m2, including a covered area of over 383 m2, flower beds of over 893 m2, and a yard of nearly 2,600 m2. The property attached to the land is Thuy Ta restaurant with an area of nearly 268 m2 with a 2-storey structure. The winning bidder will have the right to use the house and land for a period of 10 years, from the date of issuance of the approval of the auction winning decision.
The starting price for the lease auction is over 3.6 billion VND/year. Of which, the land rent is nearly 3.3 billion VND/year and the house rent is 378 million VND/year. The auction participants must deposit 20% of the starting price of nearly 730 million VND, have a written commitment to fulfill financial obligations according to the auction results and the signed lease contract. If the auction wins, the auction winner must pay a one-time fee for the entire lease term. As for the lease of water surface, the auction winner must contact the water surface management unit to negotiate the contract.
If the auction winner does not pay or does not pay the full auction winning amount within 60 days, the People's Committee of Da Lat City has the right to terminate the property lease contract, submit to the People's Committee of Lam Dong province to cancel the decision to recognize the auction winning result and the auction winner will not receive the deposit back.
Da Lat City People's Committee plans to hold the auction at the city's Administrative Center, in the form of verbal bidding with a suggested price of 150 million VND/price step.
Previously in 2023, the Lam Dong Provincial People's Committee approved the starting price for the auction of the lease rights for Thuy Ta restaurant at over 3 billion VND/year. There was a person who won the auction at over 15 billion VND/year, but withdrew the deposit because he was not allowed to change the restaurant's name.
Currently, Thuy Ta restaurant is being operated by Lam Dong Tourism Joint Stock Company. Recently, this company has submitted a petition to Lam Dong Provincial People's Committee to consider allowing the company to continue renting Thuy Ta restaurant. The company believes that the policy of reclaiming land and assets on Thuy Ta restaurant land is unfounded and requests Lam Dong Provincial People's Committee to stop organizing the auction.
