The case of breaking into a house and slashing a 'debtor' with 31% disability, receiving a suspended sentence: The victim appealed

January 6, talking to PV Thanh Nien , Judge Pham Van Tinh, Chief Justice of the Criminal Court of Ben Tre Province, said that the members of the Appellate Court are preparing to bring the case of "Intentional Infliction of Injury" involving defendant Tang Hong Huy (34 years old, residing in Thi Hamlet, Huong My Commune, Mo Cay Nam District, Ben Tre) to trial. The Appellate Court of Ben Tre Province had to postpone the first trial on January 3 because defendant Tang Hong Huy reported being sick and did not come to court as summoned.

Previously, on October 3, 2023, at the first instance trial, the People's Court of Mo Cay Nam District sentenced defendant Tang Hong Huy to 3 years in prison, suspended, and a probation period of 5 years for the crime of Intentional Infliction of Injury (according to Clause 3, Article 134, Penal Code 2015, amended and supplemented in 2017).

After the first instance verdict, the victim Tran The Hung (67 years old, in Thanh Tay hamlet, Huong My commune, Mo Cay Nam district, Ben Tre) filed an appeal, requesting a heavier sentence for the defendant and consideration of the criminal responsibility of those who accompanied the defendant to the victim's house to slash him.

Mr. Hung avoided Tang Hong Huy's slash, so the knife hit the back door of Mr. Hung's house.

Regarding the content of the case, Tang Hong Huy was hired by Tran Anh Phong (41 years old, residing in Thi Hamlet, Huong My Commune, Mo Cay Nam District) to collect monthly debt from Mr. Tran The Hung for the debt that Mr. Hung borrowed from Ms. Huynh Thi Bich Thuy (Phong's biological mother).

In July 2022, a conflict arose between Tang Hong Huy and Mr. Hung. While Mr. Hung was away, Huy went to Mr. Hung's house to drink water, broke 5 glasses, paid 200,000 VND in compensation, and then left.

At about 3:00 p.m. on July 30, 2022, after drinking alcohol, Huy called Nguyen Huu Thinh (24 years old) and Pham Chi Nguyen (26 years old, both living in Thi Hamlet, Huong My Commune) to go to Mr. Hung's house to resolve the conflict.

After that, Huy picked Thinh up and brought him to his house and gave him a bag containing two homemade knives. Huy drove Thinh by motorbike, arranged to meet Nguyen at Huong My bridge, and then the three of them went to Mr. Hung's house.

When he arrived, he saw Mr. Hung sitting in the coffee shop. Huy immediately cursed and threatened to beat Mr. Hung. Huy opened his bag, took out a homemade knife, and then approached Mr. Hung and slashed him on the shoulder with the back of the knife to scare him. After that, Mr. Hung ran into the house and threatened to slash Huy with the knife, so Huy continued to chase after him with the knife.

Huy ran around to the back door of Mr. Hung's house and swung the knife, hitting the door. Mr. Hung retreated into the house and picked up a knife next to the door, holding it up to block it. Seeing Mr. Hung bleeding profusely and the handle of Huy's homemade knife falling off the blade, Huy took the blade and ran away from the scene. Mr. Hung was taken to the emergency room at Nguyen Dinh Chieu Hospital (Ben Tre).

Mr. Hung was slashed in the chest area between the 3rd and 6th ribs, the wound was more than 4 cm long; his right hand had a severed vein, severed extensor tendons of 4 fingers, severed 1 finger joint, his left hand had a severed extensor tendon of the 4th finger... The Criminal Science Institute of the Ministry of Public Security concluded that Mr. Hung's disability rate was 31%.
