In order to ensure the rights, obligations and legitimate interests of detainees, Vietnam always thoroughly grasps and promotes management and enforcement at detention facilities, especially in Hanoi.

Consistent policy

On June 20, 2017, the 14th National Assembly issued Resolution No. 41/2017/QH14 on the implementation of 4 Codes and Laws, including the 2015 Law on Detention and Temporary Detention. This is an important legal basis to ensure the management and implementation of detention and temporary imprisonment and to ensure the rights and regimes of detainees and temporary detainees.

After the Law on Temporary Detention and Temporary Imprisonment came into effect (January 1, 2018), the Government and the Ministry of Public Security issued 3 Decrees and 14 Circulars detailing and guiding the implementation of a number of articles of the Law on Temporary Detention and Temporary Imprisonment.

It can be seen that the consistent and synchronous policies, guidelines and directions of the Party and the Government are the premise for units of the Ministry of Public Security, especially the Hanoi City Police (CATP), to seriously and effectively implement legal provisions on ensuring the rights of detainees and prisoners.

Therefore, Hanoi City Police has actively implemented forms of propaganda about the rights of detainees and prisoners to all management officers and prisoners themselves, such as: organizing a contest to learn about the Law on Detention and Imprisonment; organizing professional training for management officers and soldiers; disseminating the rights, obligations, and regulations of detention facilities of detainees and prisoners right from the time of their reception.

In addition, in recent years, Hanoi City Police have increased investment and improved facilities and equipment at investigation agencies and detention facilities. In particular, detention camps have actively applied technology and techniques in investigation and management; improved facilities for audio and video recording; resolved complaints and denunciations related to torture, forced confessions, and physical abuse to ensure the regime and policies for detainees and promptly handled violations.

Synchronized execution

According to official figures, Hanoi City Police is managing 2 temporary detention camps and 30 district-level police detention facilities with 1,028 detention cells, with an actual detention capacity of 7,919 people. From January 1, 2018 to present, detention facilities under the City Police have received 128,885 detainees, arranged detention and managed them in accordance with legal regulations.

Regarding the food, accommodation, clothing and personal belongings of detainees, Lieutenant Colonel Pham Chien Thang, Deputy Warden of Hanoi City Police Detention Center No. 1, said that the unit always ensures adequate rations for detainees. The quantitative standards for rice, vegetables, meat, fish, sugar, salt, sauce, MSG, fuel, electricity and water are all publicly posted at the cell door.

Prisoner NTH, currently being reformed at the Hanoi City Police Department's Camp No. 1, said that during holidays (New Year's Day, Lunar New Year, Hung Kings' Commemoration Day, April 30, May 1, and National Day September 2), the prison guards always increase the prisoners' food rations by 5 times compared to normal days. All food and foodstuffs have clear origins and ensure hygiene and safety, so there has been no food poisoning in the detention facility so far.

Regarding the right to receive gifts, send and receive letters, books, newspapers, documents, and spiritual life for detainees, Lieutenant Colonel Pham Chien Thang emphasized that detention facilities are equipped with loudspeaker systems to serve the dissemination and education of the law as well as for detainees to listen to domestic and international news and events. In addition, every day, detainees are provided with a local or central newspaper to access and keep informed.

Regarding the right to meet relatives, defense counsel, and consular contact of detainees, Lieutenant Colonel Nguyen Xuan Nam, Deputy Warden of Detention Camp No. 2 of Hanoi City Police, emphasized that detainees are allowed to meet relatives at the prescribed time and number of times.

The defense attorney is organized to meet the detainee to carry out the defense according to the provisions of the Criminal Procedure Code and the Law on Detention and Temporary Imprisonment in the working room of the detention facility or where the detainee is undergoing medical examination and treatment.

Regarding the medical care regime for detainees and prisoners, the City Police Department ensures that all detainees and prisoners receive a health check before being placed in a detention cell. In case of illness, they will be examined and treated by medical staff at the medical room or infirmary of the detention facility. If the illness is beyond the treatment capacity of the detention facility, the detainee or prisoner will be taken to a State hospital for treatment.

Lieutenant Colonel Nguyen Hong Hai, medical officer of Detention Camp No. 1 of Hanoi City Police, said that currently, the City Police have coordinated with Ha Dong General Hospital to build and put into use a medical examination and treatment area specifically for prisoners and inmates.

In particular, Hanoi City Police have proposed many measures to effectively prevent and control the Covid-19 epidemic in detention facilities by establishing quarantine areas, monitoring and treating detainees, prisoners infected and suspected of being infected with Covid-19 at Hanoi City Police Detention Center No.

Lieutenant Colonel Nguyen Thanh Hai, Chief of the Infirmary of Detention Camp No. 2 of Hanoi Police Department, emphasized that up to now, the total number of prisoners infected with Covid-19 at detention facilities under the Hanoi Police Department is 2,711 people, all of whom have been cured, of which 2,588 people were treated in the isolation area of ​​Detention Camp No. 2; 123 people were treated at temporary detention houses.

Efforts to promote

To continue to effectively implement measures to ensure the rights of detainees and prisoners, Hanoi City Police Department has set out tasks for the coming time with 5 main focuses.

Firstly, continue to seriously and effectively implement legal regulations, instructions and directions of the Ministry of Public Security on the management and enforcement of temporary detention and imprisonment; enhance the sense of responsibility, tighten discipline of officers and soldiers of detention facilities and investigation agencies at all levels in the performance of their duties, and prevent errors and negativity in detention management and litigation activities, affecting the rights of detainees and prisoners.

Second, strengthen the work of propaganda, dissemination and legal education so that detainees and prisoners understand their rights and obligations; organize professional training for officers and soldiers of detention facilities and investigation agencies at all levels; ensure absolute safety of detention facilities and fully implement the regime and policies for detainees and prisoners according to the law.

Third, continue to invest in, upgrade, and improve facilities and equipment at investigation agencies and detention facilities to ensure the regime and policies for detainees and prisoners.

Fourth, regularly inspect and examine compliance with legal regulations in detention management and investigation activities, promptly detect and strictly handle acts of violating the rights of detainees and prisoners.

Fifth, improve the effectiveness of coordination between detention facilities and relevant agencies and units (Investigation agencies, Courts, Procuracies, Civil Judgment Enforcement Agencies, Legal Department of the City People's Council, etc.); promote international cooperation to ensure that the rights of detainees and prisoners are implemented in accordance with current laws and international conventions on human rights to which Vietnam is a party.
