What is the penalty for violating multiple traffic laws at the same time?

How are multiple traffic violations punished?

According to Point d, Clause 1, Article 3 of the Law on Handling of Administrative Violations 2012 (amended in 2020), which stipulates the principles of handling administrative violations, handling of administrative violations is prescribed as follows:

- Only impose administrative sanctions when there is an administrative violation as prescribed by law.

- An administrative violation is only punished once.

- If many people commit an administrative violation, each violator will be punished for that administrative violation.

- A person who commits multiple administrative violations or commits administrative violations multiple times shall be punished for each violation, except in cases where multiple administrative violations are prescribed by the Government as an aggravating circumstance.

Based on the above regulations, a person who commits many traffic violations or other administrative violations will be punished for each violation with a corresponding penalty level, not combining penalties and fine levels together.

All administrative violations must be detected, prevented promptly and strictly handled. All consequences caused by administrative violations must be remedied in accordance with the provisions of law.

Administrative sanctions are carried out quickly, publicly, objectively, with proper authority, ensuring fairness and compliance with legal regulations.

Administrative sanctions must be based on the nature, level, consequences of the violation, the violator, and mitigating and aggravating circumstances.

The person with the authority to impose a penalty is responsible for proving the administrative violation. Individuals and organizations subject to a penalty have the right to prove, by themselves or through their legal representatives, that they have not committed an administrative violation.

For the same administrative violation, the fine for an organization is twice the fine for an individual.

Forms of administrative sanctions

Pursuant to Article 21 of the Law on Handling of Administrative Violations 2012 (amended in 2020), the forms of sanctions and applicable principles are prescribed as follows:

+ Warning.

+ Fine.

+ Revoke the right to use a license or practice certificate for a limited period of time or suspend operations for a limited period of time.

+ Confiscate administrative violation exhibits and means used to commit administrative violations.

+ Deportation.
