(PLVN) - After many versions and many meetings to collect opinions as well as meetings with the Government, up to now, the story of "deciding" on which plan to manage petroleum business is still undecided.
Recently, reporting at the Government meeting on the issuance of a new Decree on petroleum business, replacing all current decrees, the Ministry of Industry and Trade said that after receiving comments, especially comments with different contents, the Ministry of Industry and Trade has officially submitted a new draft version, with proposals that many parties have proposed.
Specifically, the Ministry of Industry and Trade has proposed two options for trading by distribution traders (TNPP), including being allowed to trade with each other and not being allowed to trade with each other.
However, responding to PLVN Newspaper, Mr. Bui Ngoc Bao - Chairman of the Vietnam Petroleum Association (Vinpa) said that the Ministry of Industry and Trade has analyzed two options but still leans towards choosing the option of "prohibiting TNPP from buying and selling each other".
Mr. Bao affirmed that the Association still persistently recommends that TNPPs should not be banned from trading with each other. Not only Vinpa, many other ministries, branches, agencies and businesses also believe that trading with each other should not be banned, but that TNPPs should continue to trade with each other as per current regulations. Currently, this issue has not been "resolved" to decide which option to choose.
“In reality, there is a certain gap between management and reality. I think that, from a management perspective, if we want to set conditions for management, we will lean towards management measures. They think that TNPP is an intermediary object, but we think that we need to analyze it carefully. We think that TNPP is not an intermediary system, but an objective existence, a network in the petroleum supply chain,” Mr. Bao analyzed.
In addition, Mr. Bao also shared that there are usually conflicting opinions between the management agency and the managed entity. The management side wants to simplify things, "to avoid having to manage". However, according to Mr. Bao, this mindset cannot continue. At the same time, he said that the Ministry of Justice needs to get involved in this matter, to determine whether the ban on mutual trading by TNPPs issued by the Ministry of Industry and Trade is consistent with current laws. Because the Decree must comply with the Law, it cannot be contrary to the Law.
Previously, the Ministry of Justice also commented that restricting mutual trading between TNPPs would limit the choice of gasoline supply sources for TNPPs, which may not be consistent with the State's policy on competition; or could be identified as an act that hinders competition in the market.
Regarding the formula for calculating gasoline prices, Mr. Bao said that in the latest draft version, price management has also been more "open" than before. Accordingly, the Ministry of Industry and Trade has proposed two options, including managing prices according to the ceiling price and letting businesses set prices.
However, the Association and some ministries and branches still believe that gasoline is one of the nine price-stabilized commodities. This means that when the market operates normally, this commodity must comply with the provisions of the 2023 Price Law, which means it must operate according to the market mechanism, with prices set by businesses. State management will demonstrate its role through monitoring and managing price declarations (from businesses). "After receiving the declaration, if it is found to be unstable, the state agency has the right to request a "stop" and explain the selling price," said Mr. Bao.
Mr. Bao affirmed that when the market operates normally, the selling price must be determined by the enterprise and accepted by the market. Operating according to the ceiling price (one of the two options proposed by the Ministry of Industry and Trade) is not in accordance with the Price Law. Because according to the Price Law, only when the market is unstable, the Government will decide which stage must implement the stabilization solution, by the State issuing prices, or ceiling prices that all enterprises must comply with.
