1. Has the new red book been issued since August 1, 2024?
According to Point a, Clause 2, Article 43 of Circular 10/2024/TT-BTNMT, the validity of Circular 23/2014/TT-BTNMT stipulates the certificates of land use rights, house ownership rights and other assets attached to land as follows:
a) Circular No. 23/2014/TT-BTNMT dated May 19, 2014 of the Minister of Natural Resources and Environment regulating the Certificate of land use rights, house ownership rights and other assets attached to land, except for the case specified in Article 3 of Circular No. 23/2014/TT-BTNMT, which expires from January 1, 2025; |
Accordingly, it can be understood that although Circular 23/2014/TT-BTNMT has officially expired from August 1, 2024, the provision on the certificate form will continue to be effective until January 1, 2025.
In addition, the transitional regulations in Circular 10/2024/TT-BTNMT also clearly state that the old Certificate form will continue to be applied until December 31, 2024.
Thus, the new red book model has not been issued since August 1, 2024. However, from January 1, 2025, when carrying out procedures for issuing new, exchanging, and reissuing red books, people will be issued certificates according to the new model applied according to Circular 10/2024/TT-BTNMTT.
Note:
Clause 3, Article 256 of the 2024 Land Law stipulates that land use right certificates (commonly known as red books), certificates of house ownership and land use rights, house ownership certificates, certificates of construction work ownership, certificates of land use rights, house ownership and other assets attached to land (commonly known as pink books) that have been granted in accordance with the provisions of the law on land, the law on housing, and the law on construction before August 1, 2024 are still legally valid and do not need to be changed to certificates of land use rights and ownership of assets attached to land; in case of need, they can be changed to certificates of land use rights and ownership of assets attached to land in accordance with the provisions of the 2024 Land Law.
2. Cases where it is required to change to a new red book form from January 1, 2025
According to Clause 1, Article 38 of Decree 101/2024/ND-CP, the cases of reissuing issued certificates (red books) include:
(1) The issued certificate is stained, blurred, torn or damaged;
(2) Certificates issued for many land plots are issued separately for each land plot according to the needs of the land user and in cases of reissuance of certificates of land use rights and ownership of assets attached to land as prescribed in Clause 7, Article 46 of Decree 101/2024/ND-CP;
(3) The purpose of land use stated on the granted certificate according to the provisions of the law on land at the time of granting the granted Certificate is different from the purpose of land use according to the land classification prescribed in Article 9 of the 2024 Land Law and the provisions of the Government's Decree detailing the implementation of a number of articles of the 2024 Land Law;
(4) The location of the land plot on the issued Certificate is incorrect compared to the actual location of land use at the time of issuance of the issued Certificate;
(5) The land use right and ownership of property attached to the land are the common property of the husband and wife, but the issued certificate only records the full name of the wife or the husband. Now there is a request to reissue the land use right and ownership of property attached to the land to record both the full name of the wife and the full name of the husband;
(6) The issued certificate records the name of the household. Now, members who share the land use rights of that household request to issue a new certificate of land use rights and ownership of assets attached to the land to record the full names of members who share the land use rights of the household;
(7) Change the address of the land plot that has been granted a certificate;
(8) Changing the dimensions of edges, area, and land plot numbers due to cadastral mapping and cadastral measurement of land plots without changing the land plot boundaries.
In addition, if land users need to change the certificate issued before August 1, 2024 to a Certificate of land use rights and ownership of assets attached to the land, they will also be changed according to regulations;
3. What is the new red book model like?
The new red book/pink book form will follow the form in Circular 10/2024/TT-BTNMT. Specifically:
The certificate of land use rights and ownership of assets attached to land (commonly known as red book/pink book) will consist of one (01) sheet with two (02) pages, printed with a bronze drum pattern, lotus pink, measuring 210 mm x 297 mm, with the National Emblem, National Name, the words "Certificate of land use rights and ownership of assets attached to land", the Certificate issuance number (serial number) consisting of 02 Vietnamese letters and 08 digits, the words "Detailed information is shown in the QR code", the number entered in the Certificate issuance book and the notes for the person granted the Certificate (called the Certificate blank).

The form of land use rights certificate and property ownership rights attached to land shows the following contents:
- Page 1 includes: National emblem, National name; the words "Certificate of land use rights, ownership of assets attached to land" printed in red; QR code; Certificate code; section "1. Land user, owner of assets attached to land:"; section ". Land plot information:"; section "3. Information of assets attached to land:"; place name, date of signing the Certificate and the agency signing the Certificate; Certificate issuance number (serial number); the words "Detailed information is shown in the QR code";
- Page 2 includes: section “4. Land plot diagram, assets attached to land:”; section “5. Notes:”; section “6. Changes after the issuance of the Certificate:”; number entered in the Certificate issuance book; notes for the person granted the Certificate;
- The content and form of specific information on the certificate of land use rights and ownership of assets attached to land are implemented according to Form No. 04/DK-GCN of Appendix No. 01 issued with Circular 10/2024/TT-BTNMT.
