The contribution of copyright-based cultural industries to the economies of countries is currently quite large, for example, the US 11.99% of GDP, South Korea 9.89% of GDP, France 7.02% of GDP... In Vietnam, from 2018 to 2023, the estimated added value of these industries contributing to the economy is more than 4% to more than 6%. However, copyright infringement on digital platforms is becoming increasingly complicated.
Hard to control
Mr. Pham Thanh Tung, Deputy Head of the Department of Management and International Cooperation on Copyright and Related Rights under the Copyright Office (Ministry of Culture, Sports and Tourism), acknowledged that the protection of copyright and related rights in the digital environment has not yet met the requirements. The level of investment in resources and human resources for the application of information technology in the prevention of copyright and related rights infringement in cross-border cyberspace has not been commensurate with the requirements in the new situation.
According to Mr. Pham Hoang Hai, Director of the Center for Radio, Television and Electronic Information Measurement - Department of Radio, Television and Electronic Information (Ministry of Information and Communications), there are currently about 100 websites violating football copyrights with a total of 1.5 billion views in the 2022-2023 season. For content about movies and other cultural products, there are about 200 pirated websites with about 120 million views/month. "Recently, we discovered a number of websites with servers located abroad violating copyrights on comics. Some Japanese organizations have worked with the Ministry of Information and Communications, reflecting on violations of comics on cyberspace that have caused hundreds of millions of USD in damage to copyright owners," Mr. Hai informed.

Mr. Pham Hoang Hai acknowledged that the issue of copyright infringement in cyberspace is extremely complex and sophisticated with many different forms. Meanwhile, cyberspace is a cross-border space, so it is difficult to identify the subject and the act of infringement.
Mr. Hoang Long Huy, Head of the Department of Cultural Industry Management - Copyright Department (Ministry of Culture, Sports and Tourism), pointed out that the development of science, technology and engineering has led to the ease of copying products on cyberspace. Meanwhile, it is difficult for management agencies to identify and handle violations, especially in cases involving foreign elements. On the other hand, some authors and owners have not yet fully grasped the legal regulations and have not proactively applied measures to protect their legitimate rights and interests.
Prevent with technology
"Protecting copyright in the digital environment is similar to protecting assets in the physical environment," said Mr. Hoang Dinh Chung, Director of the Digital Copyright Center - Vietnam Digital Communications Association. However, one of the difficulties is that Vietnamese content businesses are often small in scale and have difficulty hiring lawyers to handle copyright infringement issues.
Commenting on the solution, Mr. Chung said that technology is one of the tools that plays an important role in copyright protection on digital platforms. Therefore, entities need to pay attention to solutions that support copyright registration, automatic content censorship, copyright legal support or copyright infringement detection and reporting.
According to Mr. Pham Thanh Tung, in addition to encouraging entities to apply technological measures to protect copyright in the digital environment, management agencies must have solutions to enhance corporate social responsibility, warning businesses not to buy advertising on websites or social networks that violate copyright.
According to lawyer Phan Tuong Duy, Roma Law Firm LLC, to limit copyright infringement in the digital environment, authorities can use technological measures to prevent illegal copyright exploitation, such as blocking domain names from operating. "The most important thing is to have sanctions such as administrative and criminal penalties for advertisers who choose advertising channels containing content that violates copyright and works. At the same time, review and check domain names, and take measures to prevent existing illegal websites," lawyer Duy suggested.
Mr. Nguyen Huu Nguyen, Deputy Director of the Vietnam Cyber Security Emergency Response Center, recommends that work owners should proactively check the internet to see if their work has been stolen. In case of theft, if the individual or entity posting the work is identified, the author can request removal or sue, request compensation and notify the authorities. "Most importantly, before releasing the product to the market, the author needs to register the copyright so that the management agency has enough legal basis to quickly handle it," Mr. Nguyen recommended.
