Ho Chi Minh City temporarily uses the current land price list to calculate taxes and financial obligations on land.

On the afternoon of September 21, the Ho Chi Minh City People's Committee issued an official dispatch approving the use of the land price list issued under the 2013 Land Law to resolve financial obligations and land taxes in the city.

Specifically, during the period when the City has not yet issued the Decision amending and supplementing Decision No. 02/2020/QD-UBND dated January 16, 2020 of the City People's Committee stipulating the Land Price List according to Clause 1, Article 257 of the 2024 Land Law, the City People's Committee approves the use of the Land Price List issued under the 2013 Land Law as implemented before August 1, 2024 (Land Price List according to Decision No. 02/2020/QD-UBND dated January 16, 2020 of the City People's Committee multiplied by the land price adjustment coefficient according to Decision No. 56/2023/QD-UBND dated December 21, 2023 of the City People's Committee) to resolve financial obligations and land taxes in the period from August 1, 2024 until the issuance of the Decision amending and supplementing Decision No. 02/2020/QD-UBND dated January 16, 2020 of the City People's Committee. 02/2020/QD-UBND dated January 16, 2020 of the City People's Committee regulating the Land Price List.

The City People's Committee assigned the City Tax Department, according to its functions and tasks, to urgently coordinate with the Department of Natural Resources and Environment, the Department of Finance and related units to implement the settlement of outstanding land records arising from August 1, 2024 in accordance with the law on calculating financial obligations, taxes and other relevant legal provisions such as land use fees, land rents, personal income tax from real estate transfers and land revenues.

The Department of Natural Resources and Environment and the City Tax Department provide full information so that the Department of Information and Communications can continue to coordinate with relevant agencies and units to promote communication, clarifying the contents related to the development of the Decision amending and supplementing Decision No. 02/2020/QD-UBND according to Clause 1, Article 257 of the 2024 Land Law and the implementation of finance and land taxes from August 1, 2024 until the issuance of the Decision amending and supplementing Decision No. 02/2020/QD-UBND dated January 16, 2020 of the City People's Committee regulating the land price list. Along with that, clarify the groups and subjects affected, so that people and businesses have a correct understanding of policies and legal regulations, creating consensus when implementing in the City.

Previously, the Ho Chi Minh City Tax Department sent many urgent documents to the City People's Committee regarding the settlement of land records from August 1. According to the Ho Chi Minh City Tax Department, from August 1 to August 27, 2024, the tax authority received a total of 8,808 records; of which 346 records were for land use fee collection in cases of land use right recognition; 277 records were for land use fee collection in cases of land use purpose change. In addition, there were 5,448 records of personal income tax from real estate transfer and 2,737 records in cases where no financial obligations arise (personal income tax from real estate transfer, registration fees, etc.).

Faced with this situation, the Ho Chi Minh City Tax Department recommends that the City People's Committee promptly issue a decision to adjust the land price list and provide guidance and direction on the application of legal documents so that tax authorities can promptly calculate financial obligations on land for records arising from August 1, 2024.

Currently, the Ho Chi Minh City People's Committee is also directing and assigning the city's functional agencies to develop and complete the draft Decision amending Decision No. 02/2020/QD-UBND dated January 16, 2020 of the Ho Chi Minh City People's Committee on the land price list in the area according to Clause 1, Article 257 of the 2024 Land Law. However, during the process of drafting, the new land price list has received many opposing opinions and is continuing to receive comments to complete the draft, before officially promulgating.
