General standards applicable to leadership and management positions

The Decree stipulates general standards applicable to leadership and management positions of civil servants, including: political and ideological standards; standards on ethics, lifestyle, sense of organization and discipline; standards on qualifications; standards on capacity and prestige; standards on health, age, and work experience.

Decree 29/2024/ND-CP specifies the standards for each leadership and management position of the Ministry, the General Department and the specialized agencies under the People's Committees at the provincial and district levels.

Standards for the position of Deputy Minister

Regarding the position of Deputy Minister of a Ministry, the Decree stipulates that a Deputy Minister is a deputy of the Minister, Head of a ministerial-level agency (hereinafter referred to as the Minister), assisting the Minister in leading, directing, and managing one or several sectors, fields, and specialized areas of work as assigned by the Minister; responsible to the Minister and before the law for assigned duties and tasks.

Deputy Ministers must meet the general standards applicable to leadership and management positions and the following regulations:

- Have objective, comprehensive, dialectical, historical viewpoints; have a deep understanding of law, state management of the industry, management field and international practices;

- Ability to: Advise on strategic development issues of sectors and fields; direct the development and effective implementation of legal documents, topics, projects, programs, and annual and term work plans of sectors and fields; direct or directly resolve difficult and complicated issues in sectors and fields; direct the implementation of administrative reform, public service and civil servant regimes; direct the implementation of inspections, checks, and handling according to the provisions of law; direct the resolution of recommendations, complaints, and denunciations of organizations and citizens under its authority; coordinate between ministries, sectors, and between the central and local levels to synchronously, uniformly, and effectively implement the Party's guidelines, policies, and laws;

- Currently holding the position: General Director and equivalent; Deputy General Director and equivalent (having held the position of Department Head and equivalent under the Ministry); Department Head and equivalent under the Ministry; Vice Chairman of the People's Council, People's Committee at provincial level or equivalent position or title or higher according to regulations of competent authority.

Some special cases apply title standards when appointing

In addition, the Decree also stipulates a number of special cases applying title standards when appointing.

According to regulations, in case of appointing personnel from external sources, it is not necessary to ensure the standard of having experienced a position, leadership title, or management position at a direct subordinate position at the agency, organization, or unit expected to be appointed.

In case a Deputy Minister or Deputy Head of a ministerial-level agency is appointed to hold an equivalent position or title or concurrently holds another position or title, it is not necessary to fully satisfy the standards of the equivalent position or title or concurrently hold another position or title.

In case of working in the armed forces, public service units, state-owned enterprises or other agencies and organizations in the political system, being mobilized or appointed to hold leadership or management positions or titles in state administrative agencies, they must meet the standards and conditions prescribed in this Decree but do not have to immediately meet the standards on state management as prescribed for the positions or titles expected to be appointed. In these cases, the standards must be completed within 12 months from the date of the appointment decision.

Decree 29/2024/ND-CP takes effect from May 1, 2024.
