Continue to cut and simplify internal administrative procedures

Chairmen of People's Committees of provinces and centrally run cities shall proactively review and decide on decentralization of administrative procedures under their authority according to the provisions of law.

At the request of the Prime Minister, in the period of 2022-2025, ministries and ministerial-level agencies must amend and supplement to promulgate and submit to competent authorities for promulgation 232 legal documents decentralizing 699 administrative procedures (AP); ministries, agencies and localities must identify a list of internal APs under their management, announce, publicize and review to reduce and simplify at least 20% of APs and reduce at least 20% of compliance costs of internal APs.

Implementing the Prime Minister's direction, in recent times, ministries, agencies and localities have made great efforts and achieved some specific results. Regarding the decentralization of administrative procedures according to Decision No. 1015/QD-TTg, 13/21 ministries and ministerial-level agencies have issued and advised competent authorities to issue 34 legal documents to implement the decentralization plan of 139 administrative procedures, however, only 20% of administrative procedures have been approved for decentralization.

Regarding the review and simplification of internal administrative procedures according to Decision No. 1085/QD-TTg, 21/22 ministries, ministerial-level agencies, and 61/63 localities have announced a list of 4,028 internal administrative procedures implemented between state administrative agencies and within each ministry and locality; 05 localities have reviewed a total of 117 internal administrative procedures, of which 32 internal administrative procedures have been reduced and simplified.

The above results are still modest and do not meet the requirements of the Prime Minister. There are still 08 ministries and agencies that have not implemented decentralization, in which many decentralization plans under the authority of the Minister have not been proactively implemented by the ministries; some decentralization plans have exceeded the deadline but have not been completed.

Some ministries, agencies and localities have not fully understood the importance of internal administrative procedures; leading to incorrect identification and lack of announcement of internal administrative procedures under their management. Many ministries, agencies and localities have not been proactive in reviewing and proposing solutions to simplify internal administrative procedures. The progress of reviewing priority groups of internal administrative procedures is still slow compared to requirements (except for the Ministry of Transport), the review results have not ensured quality, and have not met the set goals and requirements.

According to the assessment of some National Assembly deputies at the 6th Session of the 15th National Assembly, internal administrative procedures in some areas are still not suitable, are barriers, and are the cause of low efficiency of state administrative agencies, increasing time and social costs, reducing management effectiveness, in which some problems are slow to be resolved.

Implement internal administrative procedure control right in the process of drafting legal documents

To continue promoting the implementation of the task of decentralizing administrative procedures and reducing and simplifying internal administrative procedures, creating convenience for people and businesses, improving the quality of public service performance, contributing to unlocking resources and developing the economy and society; Deputy Prime Minister Tran Luu Quang - Head of the Prime Minister's Administrative Procedure Reform Working Group requested:

Ministers, heads of ministerial-level agencies and government agencies shall uphold their responsibilities and proactiveness in implementing the decentralization plans approved in Decision No. 1015/QD-TTg; strive to complete decentralization of decentralization plans under the authority of the Government, Prime Minister, Ministers and heads of ministerial-level agencies that have been approved and have not yet been implemented; promptly report to competent authorities to remove difficulties and obstacles; resolutely decentralize the authority to handle administrative procedures right in the process of drafting legal documents and proactively review legal documents that stipulate administrative procedures to decentralize according to authority.

Review all documents under the authority to issue, advise on issuance and the work performed by ministries and agencies according to assigned functions and tasks, to fully announce and supplement internal administrative procedures under the scope of management; publicize 100% of internal administrative procedures between state administrative agencies under the management of ministries and agencies on the National Database on Administrative Procedures in accordance with the instructions of the Government Office; to be completed in December 2023.

Review at least 50% of the total number of administrative procedures under management, propose simplification plans to ensure the goal of reducing and simplifying at least 20% of administrative procedures and reducing at least 20% of administrative procedure compliance costs, to be completed in December 2023; the remaining 50% of administrative procedures to be completed in 2024.

Ministries and agencies need to consult and get opinions from the Working Group implementing the Plan to review and simplify internal administrative procedures and relevant ministries, agencies and localities during the review process, to ensure the quality of the plan to simplify internal administrative procedures among state administrative agencies.

Conduct internal administrative procedure control right in the process of drafting legal documents; pay attention to reviewing, amending and supplementing internal administrative procedures in the process of amending and supplementing legal documents according to the Program and Plan of the National Assembly, the Government, the Prime Minister and of ministries and agencies.

Promote the coordination, assessment and independent review role of the administrative procedure control unit at ministries and agencies; the review role of departments, bureaus and units advising on the issuance of internal administrative procedures; the role of independent experts; as well as the coordination role of agencies and units that are the subjects of implementing internal administrative procedures.

Chairmen of People's Committees of provinces and centrally run cities shall proactively review and decide on decentralization of administrative procedures under their authority in accordance with the provisions of law on decentralization and delegation, ensuring appropriate and feasible decentralization to reduce levels and intermediaries, create convenience and reduce costs for people and businesses.

Review all documents under the authority to issue and the work performed by the locality according to assigned functions and tasks, to fully announce and supplement internal administrative procedures under the scope of management; to be completed in December 2023.

Review at least 50% of the total number of administrative procedures under management, propose simplification plans to ensure the goal of reducing and simplifying at least 20% of administrative procedures and reducing at least 20% of administrative procedure compliance costs, to be completed in December 2023; the remaining 50% of administrative procedures to be completed in 2024.

Proactively research and propose simplification plans for internal administrative procedures under the authority of the National Assembly, the Government, the Prime Minister, and ministries managing sectors and fields in which localities are the subjects of implementation, and closely coordinate with ministries and agencies in the process of reviewing and simplifying these administrative procedures to ensure appropriate and feasible reduction and simplification plans.

5 Ministries speed up review and simplification of priority administrative procedures

The Ministries of Industry and Trade, Planning and Investment, Home Affairs, Finance, and Natural Resources and Environment shall accelerate the review and simplification of priority administrative procedures according to Decision No. 1085/QD-TTg and Decision No. 933/QD-TTg dated August 6, 2023, submit to the Prime Minister for approval of the simplification plan; ensure the goal of cutting and simplifying at least 20% of administrative procedures and cutting at least 20% of administrative procedure compliance costs, to be completed in December 2023.

The Government Office assists the Prime Minister in urging, guiding, and inspecting ministries, branches, and localities to effectively implement the Government's and Prime Minister's directions on decentralization of administrative procedure settlement and reduction and simplification of internal administrative procedures; synthesizes implementation results, promptly proposes solutions to remove difficulties and obstacles, and integrates them into the Report on administrative procedure reform submitted to the Government.

Ministers, Heads of ministerial-level agencies, Government agencies, Chairmen of People's Committees of provinces and centrally-run cities shall seriously implement the requirements of the Head of the Prime Minister's Administrative Procedure Reform Working Group stated in this document; periodically summarize the implementation results in the Administrative Procedure Reform Work Report to be sent to the Government Office every month./
