Practice requires comprehensive revision of the Law on Science and Technology

The Law on Science and Technology 2013 has updated new challenges and trends, in line with the Party and Government's guiding viewpoints to promote science and technology in the period of 2015-2020. However, science and technology have developed rapidly, and many current regulations are not suitable.

The Ministry of Science and Technology said that the implementation of the Law on Science and Technology 2013 shows that the current law has some contents that are not suitable to the requirements and demands from practice to develop science and technology and socio-economic development, specifically:

Firstly, our country's economy is strongly transforming to a socialist-oriented market mechanism. The need for socio-economic development with a growth model based on high-quality human resources and the driving factor of Science, Technology and Innovation (S&I) is increasingly evident, requiring the State to have mechanisms and policies to serve this purpose. However, current laws do not provide sufficient mechanisms to attract, train and develop high-quality human resources for S&I.

Second, the impacts of Vietnam's deep and comprehensive integration in a world of strong and sudden development, especially in science, technology and innovation, require legal corridors and policy mechanisms to be adjusted to suit reality.

Third, new waves of technology develop rapidly and intensely, requiring governments to always be ready to adjust policies and adapt promptly.

Fourth, many contents originating from practical situations or international practices in science and technology activities have not been supplemented or updated in the 2013 Law on Science and Technology, such as: Deploying science and technology tasks in sudden and urgent situations related to national safety and security; people's health and lives; natural disasters that threaten the living environment of humans, animals, plants and ecosystems...

Fifth, inappropriate regulations in the 2013 Law on Science and Technology such as: The issue of assigning ownership of science and technology results using the state budget to the presiding agency according to an automatic mechanism; the issue of focusing resources mainly on science and technology programs to create knowledge but not paying attention to allocating adequate resources for knowledge application programs...

From practice as well as difficulties and obstacles in the implementation of the 2013 Law on Science and Technology, the Ministry of Science and Technology finds it necessary to study and comprehensively amend the Law on Science and Technology.

The purpose of building the Law on Science, Technology and Innovation is to positively, effectively and efficiently impact scientific research activities, technology development and application according to a comprehensive approach of the national innovation system, promoting all three functions of knowledge creation, knowledge application and knowledge dissemination more strongly in social life and contributing to humanity.

From there, promote economic growth, ensure national security and safety, improve people's material and spiritual life, make science, technology and innovation truly become the driving force to complete the country's industrialization and modernization, and achieve the dual national goals by 2030 and 2045 as set out by the 13th National Congress.

Develop the Law on Science, Technology and Innovation from the perspective of fully and promptly institutionalizing the Party's guidelines and policies and the State's policies and laws on science, technology and innovation; promote decentralization, delegation of power, and simplify administrative procedures in state management of science, technology and innovation. Simplify processes and procedures, promote digital transformation in scientific research, technology development and innovation activities, especially in state management activities; enhance transparency, ethics and integrity in science and technology activities.

Inheriting the provisions of the 2013 Law on Science and Technology is also consistent with the Party's policies and guidelines, consistent with the reality of science and technology development in Vietnam and international practices. Issuing new policies through specific regulations creates a legal basis for rapid and sustainable development of science and technology, keeping up with the development of science and technology in the world.

Expand the scope and subjects of regulation of the Law to the non-public sector to promote scientific research, technology development and innovation, contributing increasingly effectively to socio-economic development, contributing to the industrialization and modernization of the country.
