Negotiation and signing of collective labor agreements have many innovations.
According to Vice President of the Hanoi Labor Federation (HLF) Nguyen Huy Khanh, the dialogue and collective bargaining tasks of the Capital Labor Union have achieved many outstanding results in recent times. The coordination in implementing the grassroots democracy regulations and dialogue at the workplace continues to have positive changes with 100% of units organizing conferences for cadres, civil servants, and public employees and 78.68% organizing conferences for workers.
Negotiation and signing of collective labor agreements - especially in non-state enterprises - have been focused on and have had many innovations, with 81.75% of enterprises having grassroots unions signing collective labor agreements, quality A, B accounting for 47.15%, higher than the national average.
In 2024 alone, the first year of implementing the Resolution of the 13th Congress of the Vietnam General Confederation of Labor and the Resolution of the 17th Congress of the Hanoi General Confederation of Labor, the Capital's Trade Unions at all levels signed new, revised, supplemented, and re-signed 1,725 copies of the Collective Labor Agreement (reaching 287.5%); of which 715 copies were newly signed, reaching 119% of the target assigned by the Vietnam General Confederation of Labor.
Chairman of the Hanoi Industrial and Export Processing Zones (IPZ) Trade Union Nguyen Dinh Thang said that the number of labor disputes and collective work stoppages at enterprises has decreased. Over the past two years, there have been no work stoppages in the Hanoi IPZs. This result was achieved thanks to the important contributions of trade unions at all levels in participating in implementing the law on democracy at the grassroots level, especially in dialogue and collective bargaining.
Notably, the content of negotiations and dialogues has focused more on ensuring the core rights of workers such as wages, bonuses, working hours, rest hours, meal quality, housing, travel, etc.
Chairwoman of Cau Giay District Labor Federation Nguyen Thi Thu Ha said that in order to improve the effectiveness of dialogue, negotiation, and signing of collective labor agreements with non-state enterprises, from the beginning of the year, the District Labor Federation proactively reviewed the list of units that have not yet established a collective labor agreement, and the units whose collective labor agreements are about to expire need to re-sign. After that, an official dispatch was issued to each unit on the reviewed list and tasks were assigned to each cadre to urge and request implementation within the prescribed time.
For units that have not yet established a Collective Labor Agreement, the District Labor Federation shall make a checklist and send it to the District People's Committee to issue an inter-sectoral inspection decision to determine the reasons; at the same time, guide and support units to implement the regulations on a legal basis.
To support grassroots trade unions in the process of negotiating, bargaining and signing the Collective Labor Agreement, Chairman of the Long Bien District Labor Federation Nguyen Truong Giang said that the District Labor Federation has had a number of solutions to support grassroots trade unions such as: enhancing the role and responsibility of district labor federation officials in urging, guiding negotiations, bargaining and signing the Collective Labor Agreement in conjunction with monthly emulation assessments and annual classification of civil servants; organizing training courses, improving the quality of trade union officials' activities, practicing skills in dialogue, negotiation, bargaining and signing the Collective Labor Agreement.
At the same time, proactively coordinate with relevant agencies to strengthen inspection and examination of the implementation of labor laws as well as the negotiation, signing and implementation of collective labor agreements in enterprises... to ensure that there are more favorable provisions for employees than those prescribed by law.
Top priority for dialogue and collective bargaining activities
In addition to the achieved results, Vice President of Hanoi Labor Federation Nguyen Huy Khanh pointed out that the dialogue, collective bargaining, and signing of collective labor agreements still have shortcomings and limitations such as: dialogue and collective bargaining are still formal, of low quality, not focused on core issues such as salary scales, payrolls, wages, working hours, rest hours, and benefits; collective bargaining has many participating enterprises, and the industry level has not received due attention...; some grassroots trade unions have not fully implemented the steps to collect employees' opinions before and during the process of building agreements...
In order to improve the quantity and quality of collective labor agreements on wages and bonuses, Mr. Nguyen Dinh Thang (Chairman of the Hanoi Industrial and Social Trade Union) said that it is necessary to strengthen the role of union officials at all levels in orienting, propagating, and providing detailed instructions on steps for grassroots unions to have the capacity, knowledge, and negotiation skills. In particular, focusing on training a team of lecturers and experts in negotiating collective labor agreements for grassroots officials;
Along with that, develop guiding documents on negotiation, bargaining, and signing of collective labor agreements; strengthen training, seminars, dialogues, and experience sharing among business units to improve union organization and activities...
Ms. Nguyen Thi Thu Ha, Chairwoman of the Cau Giay District Labor Federation, proposed that the Trade Unions at all levels should base on the production and business situation of each enterprise to negotiate and sign a collective labor agreement with many benefits for employees such as: salary, salary increase; allowances and subsidies: shift meals, overtime meals; types of vocational allowances, business trip expenses, gasoline, telephone, etc.
It is worth noting that it is necessary to continue raising awareness among union officials at all levels, employers and employees about the work of negotiating, signing and implementing the Collective Labor Agreement in labor relations. Union officials need to clearly identify the role and importance of negotiating, signing, implementing and supervising the implementation of the Collective Labor Agreement in building labor relations. This is an important legal basis for the Union to protect the legitimate rights and interests of union members and employees.
