On August 5, at the regular Government press conference in August 2024, Deputy Minister of Construction Bui Xuan Dung said that to date, the Government, the Prime Minister and the Ministry of Construction have issued 5 decrees, 1 decision and 2 circulars under the authority of the Ministry of Construction detailing and guiding the implementation of the Housing Law and the Law on Real Estate Business.
Thus, the issuance of documents guiding the implementation of the two laws was timely, ensuring progress, implementation and taking effect from August 1, 2024.
Some new points affecting the real estate market. Regarding the Housing Law, which took effect from August 1, it has overcome the overlapping legal provisions related to investment procedures, land, housing, real estate business, construction, creating a clear and transparent legal corridor for implementation. At the same time, the guiding decrees clearly stipulate the procedures for implementing projects in the direction of simplifying procedures and shortening the time for implementing projects.
The Housing Law 2023 has been amended and supplemented with a number of regulations on the development of commercial housing, social housing, resettlement housing, and individual housing to facilitate organizations, businesses, and individuals to participate in project development, especially supplementing regulations on the stages of housing investment projects such as Article 34 of the Housing Law; at the same time, Decree 95/ND-CP of 2024 of the Government has clearly stipulated the stages of investment in housing construction projects; the order of project implementation according to the process of simplifying procedures and shortening time.
For social housing development, clearly define the responsibility for allocating land funds to localities; reduce regulations on residence conditions for social housing tenants, leaving only one condition on income.
The investor is exempted from land use fees and land rent for the entire land area of the project. In addition, the investor does not have to carry out procedures for determining land prices, calculating exempted land use fees and land rent, and does not have to carry out procedures for requesting exemption from land use fees and land rent.
With the 2023 Law on Real Estate Business, legal documents detailing and guiding implementation clearly stipulate the types of real estate products and projects put into business, publicize real estate information; conditions applicable to organizations and individuals doing real estate business...
In August and September, the Ministry of Construction and specialized agencies will coordinate to disseminate laws and decrees that take effect from August 1 to 63 provinces and cities nationwide to bring laws and decrees into life, promoting the transparent and healthy development of the real estate market.
