The amendment of the Law on Technical Standards and Regulations is expected to meet integration requirements, be consistent with Vietnam's international commitments, create a transparent production and business environment, promote the development of the trade market, contribute to improving competitiveness, and develop national quality infrastructure.

Completing institutions to promote technical standards and regulations activities On the afternoon of November 22, continuing the program of the 8th Session, the National Assembly listened to the Presentation and the report on the draft Law amending and supplementing a number of articles of the Law on Technical Standards and Regulations. Presenting the draft law, Minister of Science and Technology Huynh Thanh Dat said that the 2006 Law on Technical Standards and Regulations was developed and promulgated in the context of Vietnam negotiating and joining the World Trade Organization (WTO) with the requirement to complete the legal framework on technical standards and regulations, conformity assessment, remove unnecessary technical barriers in trade, and promote global trade facilitation. Through more than 17 years of implementation, the law has improved both quality and quantity of activities in this field, contributing to promoting the improvement of productivity, quality, production and business capacity of enterprises, and promoting the export of key Vietnamese goods to the world market. However, the practice of law enforcement in recent times has shown that there have been some limitations and shortcomings that need to be addressed and resolved. Therefore, the objective of developing this draft law is to perfect the institution to promote the activities of standards and technical regulations to meet the requirements of socio-economic development towards industrialization and modernization of the country, promoting deep international integration.

The Minister of Science and Technology stated that the draft law institutionalizes the policies and guidelines of the Party and State, especially concretizing the guiding viewpoints of the Secretariat in Directive No. 38-CT/TW dated July 30, 2024 on promoting national standards, measurement and quality. According to Minister Huynh Thanh Dat, the draft amends and supplements 19 out of a total of 71 articles (accounting for 26.7%) of the Law on Standards and Technical Regulations. These regulations fully reflect the 6 groups of policies approved by the Government, focusing on perfecting regulations to ensure compliance with commitments to implement the WTO/TBT Agreement and new-generation FTAs, in line with international practices related to concepts, terminology, national standardization strategies, national quality infrastructure, transparency of technical barriers to trade, preparation of impact assessment reports of technical regulations, and provision of cross-border conformity assessment services. Promote socialization of activities related to the development of standards, technical regulations and testing, certification and appraisal activities to effectively exploit social resources, in accordance with international practices.![]() |

Complete regulations on subjects, order, procedures for developing, appraising, announcing, and promulgating Vietnamese standards and technical regulations; develop standards and technical regulations according to shortened procedures and procedures; establish impact assessments when developing technical regulations to ensure feasibility, effectiveness, and efficiency of state management, while not hindering production and business activities. The draft law also adds regulations on the national database on standards and technical regulations; innovate the publishing and distribution of Vietnamese standards in the direction of facilitating people and businesses to access information and effectively apply standards and technical regulations. Complete regulations on conformity assessment activities to internalize commitments in new-generation FTAs, while ensuring effectiveness and efficiency in domestic management, supporting businesses to develop sustainably, etc. Review, amend, and supplement more specific regulations to ensure feasibility.![]() |

Presenting his views on the draft law, Chairman of the National Assembly's Committee on Science, Technology and Environment Le Quang Huy expressed his agreement with the need to promulgate the law and said that this amendment will meet integration requirements, be consistent with Vietnam's international commitments, create a transparent production and business environment, promote the development of the trade market, contribute to improving competitiveness, and develop national quality infrastructure. The Committee suggested that it is necessary to continue reviewing and fully institutionalizing the Party and State's guidelines and policies, especially some contents in Directive No. 38-CT/TW dated July 30, 2024 of the Secretariat; continue to research, review, amend and supplement more specific regulations, avoid general regulations, and ensure feasibility. In addition, it is necessary to concretize the state's policies on developing activities in the field of standards and technical regulations into specific provisions, more clearly demonstrating the state's viewpoints and policies in the process of international economic integration. Regarding the National Standardization Strategy, the Committee for Science, Technology and Environment basically agrees with the addition of provisions on the strategy as in the draft law. However, it is recommended to study and clearly stipulate the stages, periods, viewpoints, goals, and visions; supplement regulations on orientation content, assessment of the current situation, and completion of national quality infrastructure; clearly stipulate the national standardization agency to ensure compliance with international practices; consider issuing the annual and 5-year national standards development plan to ensure consistency with the strategy. Regarding transparency and notification activities, questions and answers on technical barriers in trade, conformity assessment procedures, conformity declaration, conformity declaration, the Committee for Science, Technology and Environment basically agrees and proposes to review, research, and further specify the content of transparency and notification activities, questions and answers and documents guiding the implementation of the law and detailed regulations on the responsibilities of relevant entities, activities that must be performed and conditions to ensure transparency; supplement regulations on conformity declaration and conformity declaration in the electronic environment to facilitate, reduce administrative procedures, costs, and time for organizations and enterprises...
