The Ministry of Finance said that many new regulations have been added to simplify compensation procedures and ensure the rights of motorbike insurance buyers. Meanwhile, many people still find it troublesome and the procedures unclear.
The procedure is quite simple in legal regulations.
In a recent response to voters' petitions, the Ministry of Finance stated that Decree No. 67/2023/ND-CP of the Government has inherited and supplemented many new regulations to simplify compensation procedures and ensure the rights of motorcycle insurance buyers.
According to VietNamNet Newspaper, Decree No. 67 stipulates: With an insurance premium of 55,000 VND or 60,000 VND, in case of an accident to a third party in terms of health or life, the insurance will pay the third party a maximum of 150 million VND/person/accident; for property, the insurance will pay a maximum of 50 million VND/accident.
Upon receiving notice of an accident, within 1 hour, the insurance company must instruct the insurance buyer/insured on safety measures, precautions to limit damage to people and property, guide the documents and procedures for insurance claim; closely coordinate with the insurance buyer/insured, third parties and related parties within 24 hours to organize the implementation of loss assessment to determine the cause and extent of loss as a basis for settling insurance claims.
Within 3 working days from the date of receipt of notification from the insurance buyer/insured person about the accident, the insurance company must make an advance payment for compensation for damage to health and life.
In case the accident is determined to be within the scope of compensation for damages: Advance payment of 70% of the estimated insurance compensation according to regulations for one person in an accident in case of death; 50% of the estimated insurance compensation according to regulations for one person in an accident in case of bodily injury.
In case the accident is not yet determined to be within the scope of compensation for damages: Advance payment of 30% of the prescribed insurance liability limit for one person in an accident in case of death and estimated injury rate of 81% or more; 10% of the prescribed insurance liability limit for one person in an accident in case of estimated injury rate of 31% to less than 81%.
Within 5 working days from the date of the accident, except in cases of force majeure or objective obstacles, the insurance buyer/insured person must send a written or electronic notice of the accident to the insurance company.
It can be seen that, according to the above regulations, the procedure is quite simple and quick.
Complex reality makes many people discouraged
However, it seems that many people still do not know about the above regulations, or lack confidence in the compensation procedures, thinking that it is more trouble than benefit.
The article “Buying compulsory motorbike insurance: Collecting nearly 740 billion, paying more than 28 billion VND” published by VietNamNet Newspaper on February 5 received the attention of many readers.
Reader Do Son confided: "For many years, I bought motorbike insurance just because I was afraid of being fined when the traffic police checked without having all the required documents, but I didn't think the insurance would pay in case of an accident, and I didn't know the procedures to get paid."
Reader Duy Duy said that “the process to receive insurance is confusing and unclear. I only know how to buy but do not know how to enjoy the benefits”.
According to reader Khoa Nguyen , in fact, the fee of 60 thousand is not much if the insurance can pay up to 150 million VND/person/accident. The important thing is that the procedures to receive benefits are not clear.
Reader An commented that compulsory insurance in Vietnam is not practical when insurance companies always deliberately avoid compensation, citing many reasons, "giving birth" to many procedures, and creating many documents to discourage people and make them quit. The government should have sanctions against insurance companies, punish them severely, then maybe insurance companies will do business properly. At the same time, it is also necessary to simplify compensation procedures and documents.
Speaking with VietNamNet Newspaper, Lawyer Truong Thanh Duc, Director of ANVI Law Firm, noted: In essence, motorbike insurance plays a very important and necessary role in the context of Vietnam having too many motorbike accidents, and many motorcyclists causing accidents do not have enough money to compensate the victims. The insurance amount will contribute to ensuring the safety of the victims. Looking at it from this perspective, it is necessary to buy motorbike insurance.
However, in reality, people reacted quite negatively to the story of compulsory motorbike insurance because they were concerned that when an accident happened, it would be difficult to receive compensation because of complicated procedures, and insurance companies put forth many "tricky" regulations to have an excuse to "wash their hands of it".
For example, according to the law, when an accident occurs, the insured person must be responsible for: Immediately notifying the insurance company via the hotline; Not moving, dismantling or repairing property without the approval of the insurance company, except in necessary cases to ensure safety, prevent and limit damage to health, life and property or to comply with the request of a competent authority.
However, in many accident cases, because of panic, people do not remember what to do immediately, leading to not meeting the conditions for compensation payment, and have to accept the loss of benefits.
If this situation does not improve, Mr. Duc also supports the idea of abolishing compulsory civil liability insurance for motorbikes.
