Time to withdraw one-time social insurance for people on maternity leave

From April to September 2023, Ms. Nguyen Thi Nhan took maternity leave and stopped paying social insurance in March 2023. Ms. Nhan's total social insurance participation period is 6 years and 1 month.

Ms. Nhan wondered: "When can I go to work to receive a one-time social insurance payment?"

According to Vietnam Social Security, the conditions for receiving one-time social insurance benefits are stipulated in Clause 1, Article 8 of Decree No. 115/2015/ND-CP dated November 11, 2015 of the Government and Article 1 of Circular No. 18/2022/TT-BYT dated December 31, 2022 amending Article 4 of Circular No. 56/2017/TT-BYT dated December 29, 2017 of the Ministry of Health.

Accordingly, employees who have a request will receive a one-time social insurance payment if they fall into one of the following four cases.

Firstly, employees who are old enough to receive pension according to regulations but have not paid social insurance for 20 years; female employees who are full-time or part-time workers in communes, wards and towns who are 55 years old when they retire but have not paid social insurance for 15 years and do not continue to participate in voluntary social insurance.

Second, employees who have not paid social insurance for 20 years after one year of unemployment and do not continue to pay social insurance.

Third is workers going abroad to settle down.

Fourth, people who are suffering from one of the life-threatening diseases such as cancer, paralysis, cirrhosis, leprosy, severe tuberculosis, HIV infection that has progressed to AIDS; people with diseases and disabilities that reduce their ability to work by 81% or more and cannot control themselves or cannot perform activities to serve their daily personal needs and need someone to monitor, assist, and take complete care of them.

Thus, Ms. Nhan is in the second case, an employee who quits her job after one year but has not paid social insurance for 20 years and does not continue to pay social insurance.

According to Vietnam Social Security, the time after 1 year of unemployment is calculated from the time the employee stops paying social insurance. The 6-month period of maternity benefits does not affect the employee's eligibility for one-time social insurance benefits.
