Specifically, according to the decision of the People's Committee of Cau Giay District, the Gifted Secondary School of the University of Education is a public educational and training institution in the public education system, under the direct management of the Hanoi University of Education, under the professional direction of the District Department of Education and Training and the state management of the People's Committee of Cau Giay District.
The staffing of the Gifted Secondary School of the University of Education is determined according to the staffing standards of public educational institutions, within the total staffing of the Hanoi University of Education.

Previously, Hanoi temporarily stopped recruiting students for secondary school at Hanoi - Amsterdam High School for the Gifted, causing a stir in public opinion.
According to the representative of the Ministry of Education and Training, the 2005 Education Law stipulates that specialized schools are only available at the high school level. This content is also kept intact in the 2019 Education Law.
Meanwhile, the model of junior high school in specialized high schools is not covered by any legal regulations. However, due to historical reasons, there are still two schools, Tran Dai Nghia Specialized High School (HCMC) and Hanoi - Amsterdam Specialized High School, that have non-specialized junior high schools.
In 2023, the Ministry of Education and Training issued Circular 05 stipulating that specialized high schools will no longer have non-specialized classes. Thus, non-specialized middle school classes in specialized high schools are violating regulations.
However, the Hanoi Department of Education and Training said that Hanoi is being affected by the special mechanism of the Capital Law. Therefore, this unit will propose to continue enrolling 6th grade students of specialized high schools according to a special mechanism that does not violate the Capital Law.
Specifically, Article 22 of the Capital Law, issued on June 28, 2024, stipulates that Hanoi is allowed to invest in and build a system of public schools, high-quality educational institutions, and educational institutions with many levels of education, ensuring space, pedagogical landscape inside and outside the school, and a team of teachers to best serve the learning needs of students.
The City's public preschool and general education institutions are allowed to carry out educational cooperation with foreign educational institutions.
The Hanoi People's Committee is responsible for adjusting and supplementing preschool and general education programs for a number of subjects and supplementary educational activities at high-quality public educational institutions to suit the economic, cultural and social conditions of the capital in the direction of approaching regional and international education.
Recently, the leader of the Hanoi Department of Education and Training said that it is appropriate to propose establishing Chu Van An Secondary School under Chu Van An Specialized High School.
According to the head of the capital's education sector, the Department is currently basing on the Capital Law to guide the operations of secondary schools belonging to specialized schools - including Hanoi - Amsterdam Secondary School, which is temporarily suspending enrollment because according to regulations of the Ministry of Education and Training, there is no permission for specialized secondary schools within specialized high schools.
Researching and advising on the application of the model of specialized secondary schools in specialized schools is something that this unit really wants. Of course, this must follow the regulations and instructions of the revised Capital Law and be in accordance with the regulations of the Ministry of Education and Training on specialized school regulations.
