Kinhtedothi - Discussing at the hall, delegates focused on giving opinions on one of the key contents of the Draft Law on Government Organization (amended) related to regulations on the principle of delimitation of authority; on decentralization, delegation, and authorization.
Continuing the 9th extraordinary session of the National Assembly, on the morning of February 14, the National Assembly gave opinions on the Draft Law on Government Organization (amended). Discussing in the hall, delegates focused on giving opinions on one of the key contents of the Draft Law related to the provisions on the principle of delimitation of authority; on decentralization, delegation, and authorization. The delegates emphasized that this is a new, progressive and necessary point compared to the provisions of the Law on Government Organization and current laws.
However, according to delegates, it is necessary to review and define more clearly the content of concepts; requirements and mechanisms for implementing decentralization, specific regulations on subjects of decentralization, authorization, subjects of decentralization, authorization, conditions for decentralization, authorization and accountability mechanisms... to enhance autonomy, proactiveness, creativity and self-responsibility of agencies, units and localities associated with enhancing accountability of leaders.
Delegate Tran Van Khai (National Assembly Delegation of Ha Nam Province) proposed that it is necessary to study and supplement the principle of “conditional decentralization”. Decentralization should only be carried out when the locality has sufficient financial, human and administrative capacity; at the same time, it is necessary to develop an index to assess the administrative capacity of each locality before decentralization, and to strengthen central supervision.
Regarding decentralization, provincial delegates proposed adding a mechanism for “appraising the effectiveness of decentralization”, which clearly stipulates which tasks require annual assessment reports. Decentralization decisions must be periodically monitored by the National Assembly. At the same time, it is necessary to apply the principle of “flexible decentralization”, with localities that do not have enough capacity, there should be strict control sanctions instead of delegating all authority.
Regarding the content of authorization, the delegate of Ha Nam province proposed to limit the scope of authorization and add accountability. “Decentralization, delegation, and authorization are inevitable trends, but there needs to be a strict control mechanism. Adding regulations on monitoring and evaluating local capacity and accountability is an important factor to avoid overlap...” - delegate Tran Van Khai emphasized.
Commenting on decentralization, delegate Tran Quoc Tuan (National Assembly Delegation of Tra Vinh province) said that this is a new way of thinking of the Party and State leaders that has been legalized, which many localities are currently in great need of to liberate resources that are being held back by bottlenecks in mechanisms and policies to serve socio-economic development in the coming time.
Concerned that it would be difficult to organize and implement these contents well, delegates from Tra Vinh province proposed to add content to Article 18 of the Draft Law on Responsibilities of Ministers and Heads of ministerial-level agencies as members of the Government, submitting to competent authorities for consideration and decision on decentralization to localities when there are sufficient conditions and necessary capacity; at the same time, it is necessary to add regulations to closely monitor this content so that decentralization is truly effective and new bottlenecks are removed, new resources can be best released, in order to serve the socio-economic development of the country.
Participating in the discussion, a delegate suggested that the Government urgently direct the Central Ministries and Branches to promptly issue legal documents to guide the implementation of the Laws passed at this session. In particular, it is necessary to issue a Decree regulating "Decentralization and delegation of powers" in a clear, transparent and strict manner so that the subjects of decentralization and delegation of powers and the subjects of decentralization and delegation of powers can easily implement them smoothly and effectively...
