(PLVN) - Nearly 300 employees at the Vietnam Register (Ministry of Transport) are being compared to "invalid civil servants". The reason is that this Department is a state management agency but some tasks and powers cannot be performed because "the name is not right, so the words are not smooth".

"Playing football and blowing the whistle at the same time"

Learning about the operating mechanism of this Department, many people are quite surprised because the very first article in a Circular of the Ministry of Finance has determined that the Vietnam Register and its affiliated units are applied according to the model of a single-member LLC with 100% of charter capital held by the State.

Operating under the above-mentioned special mechanism, the Department's activities have given rise to many shortcomings that can be called "both playing football and blowing the whistle" within the apparatus originally created to carry out the task of state management of vehicle inspection.

Specifically, the Department applies a financial mechanism according to the enterprise model, so the operation process must certainly talk about revenue, profit, accounting, settlement... like a business enterprise. That means the Department and some affiliated units are allowed to participate in providing public services in the field of vehicle inspection to serve the needs of society like vehicle inspection centers of other economic sectors.

Therefore, the problem here is that when the Vietnam Register has participated in providing registration services like other enterprises, when it is time to orient and carry out state management work in this field, who will listen to what you say? And how can "you" play the "role" of the State to perform management functions such as issuing regulations, standards or establishing inspection teams to detect and handle violations in this field.

In fact, after the "big vehicle inspection scandal" was exposed, a representative of the Ministry of Public Security stated that the fact that units earn money and cover expenses on their own, and are both state management and business, is one of the reasons why many people have been prosecuted and investigated...

Need legitimacy

“In the near future, in addition to separating the function of providing public services from the state management tasks of the Department, the Ministry of Transport and the Vietnam Register will also recommend to the competent authorities to supplement the staffing of the Department, because the inspection force of the Department must be state officials to be qualified to perform specialized inspection functions in accordance with the provisions of the law on inspection and the law on cadres and civil servants,” a leader of the Vietnam Register told PLVN.

It is known that the Vietnam Register has nearly 80 trained personnel, and has been granted professional certificates in specialized inspection of registration, but due to lack of staff, they are not yet officially qualified to perform their duties.

More broadly, the entire apparatus of nearly 300 people here has long been just "inactive civil servants" when this Department is still autonomous in everything, while in some areas of work they are given the right to "take the lead" to perform state management functions like other specialized Departments in the Ministry of Transport.

According to PLVN's research, every year, this Department contributes more than 400 billion VND to the state budget from service revenue; the collection of road use fees alone for the state budget is also more than 11,000 billion VND each year. However, because the Department applies a financial management mechanism according to the model of a single-member LLC, the State management expenditure, salary payment for employees, etc., the Department must balance itself.

If the Vietnam Register is granted a staff position, the State will allocate a budget for the department and the staff here will officially be "dressed" as civil servants and receive salaries - a fundamental difference compared to officials and employees in the public sector under the Ministry of Transport.

It is expected that after the model is reorganized, the total number of civil servants of the Department will be 222 people. Of which, the staff and support departments will have 177 people. In addition, there are 3 Inspection Sub-Departments located in the three regions of North, Central and South - with 15 civil servants/Sub-Department.

They are just “workers”!

Speaking to PLVN, Deputy Minister of Transport Nguyen Xuan Sang said that the staff of this Department all have a common name: "Workers". "They are not civil servants, nor are they public employees. There are only 2 officials transferred by the Ministry from other units to work here as Director and Deputy Director who are civil servants", Mr. Sang said.

While according to the provisions of law, civil servants must be recruited, appointed to a rank, position, title, on the payroll, receive salary from the state budget or be guaranteed from the salary fund of public service units, work in agencies, organizations, and units. With their duties, those who perform state management work at the Vietnam Register must be civil servants.
