Department of Construction responds to Vinh City voters' petitions on planning and construction issues

Voters working at the Vinh City People's Committee proposed that the Provincial People's Committee delegate authority to the Vinh City People's Committee to approve site surveys, establish detailed construction plans at a scale of 1/500 for dividing residential land plots with a scale of <5.0ha and locations for establishing technical infrastructure plans (traffic routes with a road width of less than 13.0m; wastewater treatment stations; wastewater pumping stations, etc.) in areas that are in accordance with the 1/2,000 scale zoning plan approved by the Provincial People's Committee.

* Response content:

- Regarding the content of the proposal for the Provincial People's Committee to decentralize to the Vinh City People's Committee to approve the site survey and establish a detailed construction plan at a scale of 1/500 to divide residential land plots with a scale of <5.0ha: This content was proposed by the Vinh City People's Committee at the working session to listen to and comment on the Draft Decision regulating the assignment and decentralization of construction planning management in Nghe An province to replace Decision No. 36/2017/QD-UBND dated March 16, 2017 of the Provincial People's Committee dated November 10, 2022. At the meeting as well as the explanatory report of the Department of Construction, this content was not agreed upon because residential land and housing planning projects, in addition to being consistent with approved plans, must also be based on the approved Program and plan for housing development in Nghe An province.

- Regarding the content of the proposal for the Provincial People's Committee to decentralize to the Vinh City People's Committee to approve the survey of locations for technical infrastructure planning (traffic routes with a right-of-way of less than 13.0m; wastewater treatment stations; wastewater pumping stations) in areas that are in accordance with the 1/2,000 scale zoning plan approved by the Provincial People's Committee: This content has been stipulated in Article 13 of Decision No. 62/2022/QD-UBND of the Provincial People's Committee promulgating regulations on decentralization of construction planning management in Nghe An province. Regarding the implementation of traffic routes with a right-of-way of less than 13.0m, the Vinh City People's Committee is requested to base on the approved zoning plan to establish construction investment projects.

Voters working at the Vinh City People's Committee proposed that the Provincial People's Committee authorize the Vinh City People's Committee to appraise and approve local adjustments to the zoning plans of wards and communes for the route and cross-section of roads with a width of less than 13.0m (after receiving the policy of the Provincial People's Committee and the consensus of the Department of Construction) .

* Response content:

According to the provisions of Chapter III and Chapter IV of the 2009 Urban Planning Law, the level that approves the planning will approve the planning adjustment. According to the provisions of Clause 2, Article 44 of the 2009 Urban Planning Law, the zoning plan of wards and communes in Vinh city is approved by the Provincial People's Committee. Therefore, the proposal of voters working at the Vinh City People's Committee is not in accordance with the provisions of the 2009 Urban Planning Law.

Voters working at the Vinh City People's Committee proposed that the Provincial People's Committee direct and guide the coordination of handover of management and operation of electricity, water supply, and communication systems at land division projects using state budget capital in Vinh City to ensure consistency and compliance with regulations.

* Response content:

The technical infrastructure system of land division projects using state budget capital in Vinh city is invested by Vinh city People's Committee (or ward or commune People's Committee), accordingly, management and use are carried out in accordance with the law on management and use of public assets.

The handover of construction items and construction works (including technical infrastructure works) is stipulated in Article 27 of Decree No. 06/2021/ND-CP dated January 26, 2021 of the Government detailing a number of contents on quality management, construction and maintenance of construction works;

- Regarding water supply: comply with Decree 43/2022/ND-CP dated June 24, 2022 of the Government regulating the management, use and exploitation of clean water supply infrastructure assets;

- Regarding power supply: implement according to Decree 02/2024/ND-CP dated January 10, 2024 of the Government on the transfer of public property works to Vietnam Electricity Group.
