New regulations on summer vacation time for teachers and school staff

The Ministry of Education and Training (MOET) has just issued Circular No. 05/2025/TT-BGDDT (referred to as Circular 05), effective from April 22, 2025. This Circular regulates the working regime for general education teachers and teachers of preparatory colleges.

Circular 05 officially replaces Circular No. 28/2009/TT-BGDDT dated October 21, 2009 - this document has been applied for the past 16 years. One of the notable new points of this Circular is the addition of regulations on annual leave for principals and vice principals of general schools.

Accordingly, the principal and vice principal will have summer vacation like teachers, with vacation time arranged flexibly during the school year and summer vacation. However, to ensure the stable operation of the school, the vacation schedule of the management staff must be reported and agreed with the management agency, avoiding the situation where the entire board of directors is on vacation at the same time.

For teachers, the annual summer vacation is 2 months, including leave time according to the provisions of the 2019 Labor Code. During this time, teachers still receive full salary and allowances (if any).

According to the latest Circular of the Ministry of Education and Training, there is no regulation on summer vacation for school staff. School staff are identified as educational career civil servants, the working regime will comply with the administrative hours and regulations on working time and rest according to the Labor Code.

In case of need for summer vacation, school staff must have the consent of the principal and the vacation time must comply with the provisions of Articles 113 and 114 of this Code.

According to the provisions of the Labor Code, employees who have worked for 12 months for an employer will be entitled to annual leave with full pay. Specifically:

12 working days for work under normal conditions

14 days for underage workers, disabled workers or workers in arduous, toxic or dangerous environments

16 days for people doing especially heavy, toxic or dangerous jobs or occupations.

In addition, for every 5 years of continuous work, employees are given 1 additional day of annual leave.

Accordingly, school staff will not have long summer vacations like teachers, but will still have annual leave according to current labor laws.
