Kinhtedothi - Speaking at the group discussion session on the morning of February 13, National Assembly Chairman Tran Thanh Man emphasized the viewpoint of strong decentralization to the Government so that the Government can proactively make decisions based on practicality. The National Assembly will strengthen supervision of decrees and circulars issued by the Government.
On the morning of February 13, at the 9th extraordinary session of the 15th National Assembly, delegates discussed in groups the Draft Law on Organization of the Government (amended); the Draft Law on Organization of Local Government (amended); and the Draft Resolution of the National Assembly regulating the handling of a number of issues related to the reorganization of the State apparatus.
Participating in the discussion in groups, National Assembly Chairman Tran Thanh Man gave his opinion on the Draft Law on Government Organization (amended). Accordingly, the National Assembly Chairman emphasized that the viewpoint of strong decentralization to the Government so that the Government can proactively make decisions based on practicality is the measure to resolve bottlenecks and barriers to unlock development resources.
National Assembly Chairman Tran Thanh Man said that issues that are ripe, clear, and have been tested and proven in practice should be resolved immediately, and not because rigid processes and procedures slow down the country's development. In that spirit, when giving opinions on amending relevant laws, it is necessary to continue reviewing to ensure compliance with the provisions of the Constitution and current laws; the amended laws submitted to the National Assembly for consideration and approval this session must be consistent.
The Law on Organization of Local Government (amended) will decentralize more strongly to local governments according to the motto: locality decides, locality acts, locality is responsible. The Central Government creates, the National Assembly supervises, the Government directs and operates directly. Accordingly, the initiative of localities will be enhanced.
Discussing and clarifying some issues raised by National Assembly deputies such as the proposal to remove People's Councils at the commune level in the Draft Law on Organization of Local Government (amended), National Assembly Chairman Tran Thanh Man said: Recently, the National Assembly has piloted not organizing People's Councils in districts, wards in Ho Chi Minh City, Da Nang, Hai Phong... In the pilot areas, we will continue to implement, summarize and report to competent authorities to consider whether it can be widely replicated or not.
According to the National Assembly Chairman, it is currently impossible to "abolish" the People's Council at the commune level. If the People's Council at the commune level is not organized, the Constitution must be revised. This is an issue related to the mechanism to ensure the people's right to mastery.
The National Assembly Chairman said that the National Assembly considers and approves laws very carefully. In fact, with the same legal system, some localities implement it well, are very proactive and creative; some localities cannot implement it, are stuck in this or that, and blame it on the law or decree; some localities even complain about difficulties before they even do it... To quickly handle the work, the National Assembly has recently innovated its thinking on law-making, giving more power to the National Assembly Standing Committee because the meeting mechanism of the National Assembly Standing Committee is more flexible to solve urgent problems.
"For the National Assembly, in the coming time, the investment portfolio will not be managed, even the Government will not manage it, in order to minimize the request-grant mechanism. Because from this request-grant mechanism, a number of negative incidents have occurred, and many officials must be dealt with" - National Assembly Chairman Tran Thanh Man stated.
Along with that, the amendment of the Law on Government Organization will give the Government more power to decentralize to localities, and the National Assembly will strengthen supervision over whether the Government's decrees and circulars are in accordance with the law or not.
The National Assembly Chairman also expressed his agreement with the Government, the Chief Justice of the Supreme People's Court, and the Chief Prosecutor of the Supreme People's Procuracy considering issuing documents or authorizing the issuance of documents to resolve issues arising in the reorganization of the State apparatus under the authority of the National Assembly and periodically reporting to the National Assembly Standing Committee and the National Assembly, saying that this is a new point in the law.
Regarding the Draft Resolution of the National Assembly regulating the handling of a number of issues related to the reorganization of the State apparatus, the National Assembly Chairman informed that at this extraordinary session, 4 laws related to over 300 other laws and about 4,922 decrees and circulars will be amended.
Affirming that the great revolution in streamlining the apparatus to operate strongly, effectively, efficiently and effectively has received a very good response from the people and party members, the National Assembly Chairman clearly stated that the arrangement of the apparatus to be streamlined but strong must create favorable conditions in terms of mechanisms, prioritize human resources, select elites, talented people, and people with sufficient conditions to serve the country and the people.
Emphasizing that the amendment of the Law on Government Organization, the Law on Local Government Organization and the issuance of the National Assembly Resolution on handling a number of issues arising after the reorganization of the apparatus must closely follow the Party's policies, the provisions of the Constitution and the law to ensure quality requirements, creating a legal basis for the apparatus to operate, National Assembly Chairman Tran Thanh Man once again stated: "We must be decisive, resolute, and determined, but we must also be determined to do more to have products for the country".
