According to the Provincial People's Committee, the reason for adjusting the protection zone of this relic is because through the survey and actual assessment according to the traces of the original elements of the relic in the direction of tunnel route No. 1 and 2 of protection zones I, II (Thach Tan village) in the area passing Linh Buu pagoda, there were differences compared to the Map of the relic protection zone attached to the Decision on ranking the relic No. 985 dated May 7, 1997 of the Ministry of Culture - Information.
Therefore, it is necessary to adjust the direction of the above tunnel to ensure compliance with the provisions of the Law on Cultural Heritage, the Law on Urban Planning and Decree No. 98, dated September 21, 2010 of the Government detailing a number of articles of the Law on Cultural Heritage and the Law amending a number of articles of the Law on Cultural Heritage; at the same time, it serves as a legal basis for the implementation of restoration and embellishment of relics according to regulations.
In addition, the adjustment of the route also creates conditions for repairing damaged and degraded existing works to ensure the rights, as well as meet the needs and aspirations of people living in the relic area (Linh Buu Pagoda and households in the area).
The Provincial People's Committee proposed the Ministry of Culture, Sports and Tourism to adjust the direction of routes 1 and 2 of the protected areas I and II of Thach Tan tunnel (Thach Tan village) through Linh Buu pagoda area of Ky Anh tunnel historical relic in the following directions: Route 1: Adjust to the east (adjacent to the existing concrete road); Route 2: Adjust to the west about 21m.
The Ky Anh tunnel historical relic was ranked as a National Monument by the Ministry of Culture and Information (now the Ministry of Culture, Sports and Tourism) in Decision No. 985, dated May 7, 1997 (the protected area includes: (1) Area I: Thach Tan Tunnel (Thach Tan village): length 8km, width 20m; Vinh Binh Tunnel (Vinh Binh village): length 10km, width 20m; (2) Area 2: Thach Tan Tunnel (Thach Tan village): length 8.2km, width 80m; Vinh Binh Tunnel (Vinh Binh village): length 10.2km, width 80m).
