DNO - On the morning of April 25 in Da Nang, Chairman of the National Assembly's Committee on Science, Technology and Environment Le Quang Huy, Minister of Natural Resources and Environment Dang Quoc Khanh, and Vice Chairman of the National Assembly's Committee on Science, Technology and Environment Nguyen Tuan Anh co-chaired the 8th plenary session of the committee and gave opinions on the review of the draft Law on Geology and Minerals according to Report No. 155/TTr-CP dated April 12, 2024 of the Government.

Speaking at the meeting, Chairman of the National Assembly's Committee on Science, Technology and Environment Le Quang Huy said that geological and mineral resources are important resources for the country's socio-economic development; at the same time, they are a long-term reserve of the country.

Therefore, geological and mineral resources need to be fully planned, investigated, explored and managed centrally and uniformly.

In addition, minerals are non-renewable resources, therefore, the exploitation and use of these resources must be carried out reasonably, economically and effectively, meeting the country's development needs in the immediate and long-term periods.

The implementation of the 2010 Mineral Law over the past 13 years has achieved certain positive results, contributing to the country's socio-economic development.

However, besides the achieved results, the provisions of the current Mineral Law are still inadequate.

On the other hand, currently, a number of laws related to the field of mineral geology have been amended such as the Law on Property Auction, the State Budget Law, the Land Law... and a number of laws are being submitted to the National Assembly such as the draft Law on Cultural Heritage (amended), the Law amending and supplementing a number of articles of the Law on Property Auction.

Therefore, reviewing and amending to ensure the consistency of the legal system is very necessary.

The development and promulgation of the Law on Geology and Minerals must meet the requirements of fully institutionalizing the Party's viewpoints, guidelines and policies, contributing to perfecting the legal framework for geological and mineral activities; ensuring consistency and unity with the legal system, in accordance with international treaties and commitments to which our country is a member; overcoming shortcomings, limitations and inadequacies of the current Law on Minerals; contributing to ensuring the economical and effective management and use of minerals, towards the goal of sustainable development.

Based on the Government's proposal, the National Assembly has considered and decided to include the draft Law on Geology and Minerals in the program for consideration and comments at the 7th Session and is expected to pass it at the upcoming 8th Session.

According to Deputy Minister of Natural Resources and Environment Tran Quy Kien, the draft Law on Geology and Minerals has a number of new points, such as regulations on basic geological surveys; mineral classification; increased assignment and decentralization to local authorities; supplementing and clarifying mineral recovery activities, registering for exploitation of Group IV minerals that do not require a license for mineral exploration and exploitation.

The draft law also adds special cases allowing mineral exploitation without a mineral planning (dispersed, small-scale mineral exploitation; mineral recovery; mineral exploitation); exploitation of mineral water, natural hot water, mineral exploitation in riverbeds, lakebeds, and in sea areas without having to prepare a mineral mine closure plan but must implement a mineral mine closure plan; recognition of mineral exploration results instead of approving reserves; use of budget capital from economic career sources to organize the implementation of strategic and important mineral exploration; minerals with great economic value and demand.

Mineral exploitation right fees are determined based on the mineral volume specified in the mineral exploitation license or the volume of minerals permitted to be exploited and recovered; mineral exploitation right fees are collected annually and settled based on actual exploitation output.

Along with that, strengthen the management of sand and gravel in riverbeds, lakebeds, and sea areas; allow organizations and individuals to mortgage and contribute capital for mineral exploitation rights...

At the meeting, delegates focused on speaking and giving opinions on major policy issues, viewpoints and goals for drafting the Law on Geology and Minerals; institutionalizing the Party's guidelines and policies...

* On the same afternoon, delegates gave their opinions on the Government's reports on the implementation of Resolution No. 93/2019/QH14 of the National Assembly regarding the investment policy of the Ka Pet Reservoir project, Ham Thuan Nam district, Binh Thuan province and Resolution No. 101/2023/QH15 on adjusting the investment policy of the Ka Pet Reservoir project.

At the same time, give opinions on the examination of the Government's report on the implementation of Resolution 135/2020/QH14 on changing the purpose of forest use to implement the Ban Mong Reservoir project, Nghe An province and the Song Than Reservoir project, Ninh Thuan province.

On April 26, delegates gave their opinions on the examination of the National Marine Spatial Planning dossier for the 2021-2030 period, with a vision to 2050.
