Many violations in the mineral sector were discovered in Tuyen Quang.

(Dan Tri) - The Inspectorate of the Ministry of Natural Resources and Environment requested Tuyen Quang to clarify responsibilities in violations related to mineral exploitation activities; if violations are found to the extent of criminal prosecution, the case file will be transferred to the police.


The Ministry of Natural Resources and Environment has just issued a notice of the conclusion of the inspection of law enforcement in granting mineral exploitation licenses without auction; calculating fees for granting mineral exploitation rights and environmental rehabilitation and restoration work after mine closure by the People's Committee of Tuyen Quang province.

Specify multiple violations

Through inspection, it was discovered that 8 areas approved by the People's Committee of Tuyen Quang province as areas where mineral exploitation rights are not auctioned are not in accordance with Decree No. 15/2012 of the Government.

Tuyen Quang's demarcation of 3 areas that were granted mineral exploitation licenses after July 1, 2011 as areas where mineral exploitation rights are not auctioned is also inconsistent with Decree 15/2012.

This province also delimited 34 areas where mineral exploitation rights for barite, antimony ore, coal, manganese ore, iron ore, and tin ore were not auctioned in Decision No. 514/2017 when the Ministry of Natural Resources and Environment had not yet delimited and announced areas with scattered and small-scale minerals.

That, according to the inspection conclusion, is not in accordance with Decree No. 158/2016 of the Government detailing the implementation of a number of articles of the Law on Minerals.

The Inspectorate of the Ministry of Natural Resources and Environment pointed out that Tuyen Quang had issued License No. 07/GP-UBND in the area where the mineral mine had not been closed as prescribed in Article 73 of the Law on Minerals.

The Provincial People's Committee issued 14 mineral exploitation licenses (including License No. 32/GP-UBND) after July 1, 2011 and before the issuance of Decision No. 61/QD-UBND on delimiting areas where mineral exploitation rights are not auctioned in violation of the Mineral Law.

The approval of the price for calculating the mineral exploitation right fee in Tuyen Quang was also concluded to be "not in accordance with regulations"; the approval of the time for paying the first mineral exploitation right fee was not consistent with the time of granting the exploitation license.

Transfer the file to the police if criminal violations are detected.

After the inspection, the People's Committee of Tuyen Quang province issued consecutive decisions (in May and July) to adjust and supplement a number of contents in the mineral exploitation license granted to Dao Tu - Thanh Phat Company Limited; adjust and supplement the fee for granting the right to exploit minerals at Ao Sen limestone mine (Thai Ba village, Thien Ke commune, Son Duong district); supplement the fee for granting the right to exploit minerals at Khuon Rang limestone mine and Hang Hut village (Phuc Ung commune, Son Duong district).

The mineral exploitation license granted to Thuy Hung Company Limited and Tan Ha Mineral Joint Stock Company has also been adjusted and supplemented by Tuyen Quang with some contents.

The Inspectorate of the Ministry of Natural Resources and Environment requested the People's Committee of Tuyen Quang province to review, adjust or revoke licenses issued not in accordance with the decision approving the demarcation of areas not subject to auction of mineral exploitation rights; licenses issued not in accordance with the criteria for demarcating areas not subject to auction of exploitation rights.

"Direct the review of the responsibilities of organizations and individuals related to the above issues. In case of detecting violations that require criminal prosecution, transfer the case to the police investigation agency for handling according to the provisions of law," the inspection agency requested Tuyen Quang.

This agency also requested the Department of Natural Resources and Environment of Tuyen Quang to advise and submit to the Provincial People's Committee to demarcate areas where mineral exploitation rights are not auctioned; calculate fees for granting mineral exploitation rights, granting mineral exploitation licenses, closing mines, and rehabilitating the environment in accordance with regulations.
