Decentralize road management according to the principle of "1 job, 1 person responsible"

On the morning of November 8, Deputy Prime Minister Tran Hong Ha chaired a national in-person and online meeting to review and finalize the draft of four decrees providing detailed instructions for the implementation of the Road Law and the Law on Road Traffic Order and Safety.


Get rid of the mindset of "don't know, don't ban"

Specifically, the draft Decree stipulates the list of dangerous goods and the procedures for granting licenses and certificates of completion of training programs for drivers or escorts transporting dangerous goods on roads (draft Decree on transporting dangerous goods).

Along with that is the Decree regulating road transport activities; Decree regulating driver training and testing; Decree detailing and guiding the implementation of a number of articles of the Road Law (draft Decree on road management).

Deputy Prime Minister Tran Hong Ha emphasized that the thinking in building and promulgating institutions must be extremely innovative. Instead of "forbidding if you don't know", we should boldly decentralize and pilot new contents and policies. If they are proven correct in practice, we should summarize and include them in legal documents with higher legal effect.

Legal documents, including decrees, must create creative space for management agencies and parties involved in implementation, as well as monitoring the implementation process.

Regarding the draft Decree on the transportation of dangerous goods, Deputy Minister of Transport Nguyen Duy Lam said that the draft stipulates the list of dangerous goods, the transportation of dangerous goods, the issuance of licenses for the transportation of dangerous goods by road motor vehicles, and the issuance of certificates of completion of training programs for drivers...

Some new points of the Decree are clearly stipulating the training unit, standards for trainers, and subjects receiving dangerous goods safety training; transferring the competent authority to grant licenses for transporting dangerous goods of type 5 and type 8 from the Ministry of Science and Technology to the Ministry of Industry and Trade.

The Ministry of Transport has reviewed, adjusted and supplemented regulations on vehicle badges for transport business vehicles, four-wheeled motor vehicles; passenger transport activities, and reviewed and edited technical documents to be consistent with relevant legal documents.

The Deputy Prime Minister requested the drafting agency to review and complete regulations on registration, management of conditions and criteria for vehicles and participants in transport business activities, integrate the national population database; develop criteria and groups of conditions for piloting operations for new means of transport, and not "ban if you don't know".

In addition, the Ministry of Transport needs to study regulations to enhance the application of information technology to monitor the journey and speed of passenger cars running on fixed routes; fully and appropriately plan stations and rest stops; manage the number of passenger cars running on fixed routes according to passenger traffic... to ensure safety and healthy competition.

Regarding the draft Decree on driver training, the drafting agency has added other forms of driver training (self-study, distance learning, guided self-study); types, human resources, and material conditions of driver training facilities; organizational structure, types, and human resources of driver testing centers; driving practice grounds used to test motorcycle drivers, etc.

The Ministry of Transport has also reviewed regulations on conditions of driving practice vehicles; requiring periodic health check-ups for driving practice instructors.

The representative of the Vietnam Automobile Transport Association proposed to add the subject of driving practice teachers with high school diploma, in addition to those with intermediate professional or intermediate vocational diploma according to regulations from 2007 to present; review and reconsider the rigid regulations on the area of ​​the driving practice yard according to the ability to meet the training needs of students.

Regarding the draft Decree on road management, it clearly stipulates the conditions and criteria for each type of infrastructure project managed by the Central Government and decentralized to local management.

Localities must ensure synchronous traffic connections in terms of load and means of transport on national highways intersecting with roads in the road network planning and ensure convenient traffic connections with other roads in the area.

The Ministry of Transport is responsible for inspecting the implementation of investment by provinces according to approved road network planning, road infrastructure planning and ensuring traffic connectivity.

The Decree has provisions for transitioning the implementation of national highways decentralized to provincial-level People's Committees for management; national highways assigned by the Prime Minister to provincial-level People's Committees for management so that the management, operation, exploitation and maintenance of infrastructure are carried out continuously, ensuring the safety of road traffic infrastructure and traffic safety on the national highway system.

Regarding highway management, the drafting agency has accepted, revised, and prescribed the order of priority when agreeing on plans to expand and upgrade highways according to the principle of bidding to select investors, appointing existing investors or the State to implement.

Research on investment in rest stops must be carried out simultaneously during the research phase of investment in construction of new highway projects from the time the Road Law takes effect (January 1, 2025).

For expressways that were invested in and built before the Road Law took effect but did not have rest stops, the draft Decree has stipulated an investment and completion roadmap (Article 57 of the draft Decree).

The Deputy Prime Minister pointed out the principle of "one job, one person responsible" in decentralizing road management.

Accordingly, the Ministry of Transport and related ministries and branches are responsible for developing and promulgating plans, strategies, regulations, and design standards for the national and international road traffic system to ensure uniformity; uniformly manage all data information, design systems for monitoring and operation in each province and the whole country, "locally do, centrally manage".

Localities are decentralized in a synchronous, unified, and comprehensive manner in managing roads from investment decisions, investment budgets, operation management, maintenance, etc.; policy design ensures that when decentralizing, localities have enough resources to perform decentralized tasks.

Localities with developed economies proactively arrange budgets, while disadvantaged areas have a budget regulation mechanism from the Central Government.
