Expanding the scope of subjects granted practice licenses
In the old Law on Medical Examination and Treatment, there were 7 subjects applying for a practice certificate including: Doctor; Physician; Nurse; Midwife; Technician; Traditional Medicine Practitioner and Person with traditional medicine or traditional treatment method.
In the new Law, there are 10 professional titles that must have a practice license, adding Clinical Nutrition, Outpatient Emergency Medicine and Clinical Psychology.
Must convert medical practice certificate to practice license
According to Article 121, which provides for the transition of converting practice certificates into practice licenses, practice certificates issued before January 1, 2024 shall be converted into practice licenses according to the roadmap prescribed by the Government and shall be renewed periodically every 5 years from the date of conversion in accordance with the provisions of this Law.
The issuance of practice certificates for applications submitted before January 1, 2024 is carried out in accordance with the provisions of the Law on Medical Examination and Treatment (old), which has been amended and supplemented by a number of articles under Law No. 21/2017/QH14.
According to Article 27 of the Law on Medical Examination and Treatment (amended), each practitioner is only granted one practice license valid nationwide. The practice license is valid for 5 years. The regulation on updating medical knowledge is one of the conditions for renewing the practice license.
Foreigners practicing long-term in Vietnam and treating Vietnamese people must use Vietnamese fluently in medical examination and treatment, except in some cases of cooperation in exchanging experts, transferring technology, and training.
People mobilized to participate in medical examination and treatment in emergency situations
Article 115 stipulates the mobilization and dispatch of people to participate in medical examination and treatment activities in cases of natural disasters, catastrophes, infectious diseases of group A and emergency situations, including the following 4 groups:
- Medical practitioners, including foreigners practicing in Vietnam.
- Foreigners and Vietnamese people residing abroad who have been granted a practice license by a competent foreign agency or organization.
- Students, pupils, pupils studying in training facilities in the health sector.
- People who are eligible for a medical practice license but have not been granted a practice license.
Prohibition of alcohol and beer use at medical facilities and during medical examination and treatment
In the old Law, there were 14 prohibited items in medical examination and treatment activities. In the new Law, this list is supplemented, amended, and expanded to 21 items. In particular, the old Law prohibited practitioners from using alcohol, beer, tobacco, or having alcohol concentration in blood or breath when examining and treating patients, while the new Law prohibits the use of alcohol, beer and other alcoholic beverages, drugs, and tobacco at medical examination and treatment facilities or during medical examination and treatment.
The old law prohibits giving, receiving, and brokering bribes in medical examination and treatment. The new law prohibits acts of harassment in medical examination and treatment.
The concept of "harassment" is defined in Clause 6, Article 3 of the 2018 Law on Anti-Corruption as follows: "Harassment is the act of authoritarianism, arrogance, demands, causing difficulties and troubles of people with positions and powers while performing their duties and public services".
Change 4 professional lines into 3 levels
Regarding enhancing people's access to medical examination and treatment services, the new Law changes from 4 professional levels to 3 professional levels.
If in the old Law, the State medical examination and treatment facility system included 4 levels: Central, provincial, district, and commune, then in the new Law, the technical expertise levels in State and private medical examination and treatment include:
- Initial medical examination and treatment
- Basic medical examination and treatment
- Specialized medical examination and treatment
6 majors are fully supported with tuition and living expenses for the entire course
In Article 105, the Law stipulates that the State provides support for students majoring in: Psychiatry, pathology, forensic medicine, forensic psychiatry, infectious diseases and emergency resuscitation.
Accordingly, if studying at a training facility in the State health sector , full tuition and living expenses will be supported throughout the course.
Tuition fee support and living expenses support for the entire course corresponding to the prescribed level if studying at a private health training institution.
