Fireworks are set off on holidays and anniversaries.
According to Article 11 of Decree 137/2020/ND-CP (amended in Clause 2, Article 3 of Decree 56/2023/ND-CP), cases of organizing fireworks displays include:
(1) Lunar New Year
- Centrally-run cities and Thua Thien Hue province are allowed to fire high-altitude and low-altitude fireworks, lasting no more than 15 minutes; the remaining provinces are allowed to fire low-altitude fireworks, lasting no more than 15 minutes;
- Shooting time is at the time of Lunar New Year's Eve.
(2) Hung King's death anniversary
- Phu Tho province is allowed to fire low-altitude fireworks, lasting no more than 15 minutes, at the Hung Temple area;
- Fireworks will be held at 9:00 p.m. on the 9th day of the 3rd lunar month.
(3) National Day
- Centrally-run cities and Thua Thien Hue province are allowed to fire high-altitude and low-altitude fireworks, lasting no more than 15 minutes; the remaining provinces are allowed to fire low-altitude fireworks, lasting no more than 15 minutes;
- Shooting time is 9:00 p.m. on September 2.
(4) Dien Bien Phu Victory Day
- Dien Bien province is allowed to fire low-altitude fireworks, lasting no more than 15 minutes, at the location in Dien Bien Phu City;
- Shooting time is 9:00 p.m. on May 7.
(5) Victory Day (April 30th)
- Hanoi and Ho Chi Minh City are allowed to fire high and low-altitude fireworks, lasting no more than 15 minutes;
- Shooting time is 9:00 p.m. on April 30.
(6) Celebrating Liberation Day and founding day of provinces and centrally run cities
- Centrally-run cities and Thua Thien Hue province are allowed to fire high-altitude and low-altitude fireworks, lasting no more than 15 minutes; the remaining provinces are allowed to fire low-altitude fireworks, lasting no more than 15 minutes;
- Fireworks will be held at 9:00 p.m. on Liberation Day and the founding day of provinces and centrally run cities.
(7) National and international cultural, tourism and sports events.
(8) Other cases shall be decided by the Ministry of Culture, Sports and Tourism after having written agreement with the Ministry of Public Security and the Ministry of National Defense.
Authority and procedures for permitting fireworks to explode
According to Article 12 of Decree 137/2020/ND-CP (amended in Clause 3, Article 3 of Decree 56/2023/ND-CP), the authority and procedures for permitting fireworks are as follows:
- The cases of organizing fireworks displays as prescribed in clauses (1), (2), (3), (4), (5) and (6) shall be decided by the People's Committees of provinces and centrally run cities based on the actual situation of the locality and coordinated with the Ministry of Culture, Sports and Tourism to organize implementation according to regulations.
- In case of organizing fireworks display according to the provisions in clauses (7), (8) and cases of changing the range and duration of fireworks display, the Minister of Culture, Sports and Tourism shall decide after having a written agreement with the Ministry of Public Security and the Ministry of National Defense.
- Provinces and centrally-run cities that need to organize fireworks displays as prescribed in Clauses (7) and (8) or want to change the range and duration of the display must submit a written request to the Ministry of Culture, Sports and Tourism 30 days before the expected date of the fireworks display. The content of the document must clearly state the quantity, range, number of locations, time, duration and expected location of the fireworks display.
Within 05 working days from the date of receiving the request, the Ministry of Public Security and the Ministry of National Defense shall respond in writing for the Ministry of Culture, Sports and Tourism to synthesize and decide.
