New points on wages of employees in state-owned enterprises

On the afternoon of March 13, the Department of Labor, War Invalids and Social Affairs of Ho Chi Minh City held a conference to meet and dialogue with 100% state-owned enterprises under the City People's Committee.

According to Mr. Le Van Thinh, Director of the Department of Labor, Invalids and Social Affairs of Ho Chi Minh City, the Department organized this conference to create conditions for 100% state-owned enterprises to meet and directly discuss outstanding issues related to the field of Labor, Invalids and Social Affairs. Department officials and related departments will specifically answer the difficulties that enterprises are facing.

At the conference, Mr. Nguyen Bao Cuong, Head of the Department of Labor - Wages - Social Insurance of the Department of Labor, Invalids and Social Affairs of Ho Chi Minh City, introduced new points of Decree No. 21/2024/ND-CP amending and supplementing a number of articles of Decree No. 51/2016/ND-CP (regulating labor management, wages and bonuses for employees working in LLCs with 100% charter capital held by the State) and Decree No. 52/2016/ND-CP (regulating wages, remuneration and bonuses for managers of LLCs with 100% charter capital held by the State).

Mr. Nguyen Bao Cuong emphasized important new points about salary levels, how to build salary scales, salary increase coefficients, company rankings, etc. These contents greatly affect the salary regime in state-owned enterprises.

At the conference, the Department of Labor, Invalids and Social Affairs of Ho Chi Minh City and related departments answered 24 questions from businesses regarding labor and wages.

Most of the questions revolve around how to apply the new regulations in Decree No. 21/2024/ND-CP to the practice of calculating salaries for employees at state-owned enterprises.

Many other issues regarding labor and wages were also answered, such as: Is it appropriate for the Chairman of the Board of Members of the company to participate in the Salary Council? Paying severance pay to employees who are civil servants who have worked at many different units? In case the salary fund is reduced, how to rebuild the salary scale? When an employee no longer holds a leadership position, can the salary be adjusted to be lower than 85% of the management salary?

Concluding the conference, Mr. Le Van Thinh, Director of the Department of Labor, Invalids and Social Affairs of Ho Chi Minh City, requested that state-owned enterprises continue to coordinate with the Department in advising the City People's Committee on the content of inspection and supervision of labor norms, labor plans, planned salary funds, implemented salary funds, and enterprise rankings to ensure compliance with the prescribed time.

Regarding recommendations beyond its authority, the Department will record and report to the city leaders and central leaders to promptly provide specific instructions, creating favorable conditions for the city's business community to implement State policies promptly and effectively.
