At the 7th session, National Assembly delegates discussed in the hall a number of contents with different opinions of the Draft Law on Road Traffic Order and Safety.
One of the issues that received much attention and different opinions from National Assembly deputies was the regulation prohibiting driving a vehicle on the road while having alcohol in the blood or breath.
Speaking at the meeting, National Assembly Deputy Tran Cong Phan (Binh Duong delegation) expressed his agreement with the addition of measures to ensure safety for children, the elderly, and people with disabilities to the draft law.
However, delegate Tran Cong Phan said that when researching, especially in Article 31, a concept of “adult” appeared. The law stipulates: “When children under 7 years old cross the street, they must be led by an adult.”
Delegate Tran Cong Phan wondered who “adults” are because there is no clear regulation. “If adults are understood to mean adults, I think it is a bit of a mistake. Because, 14, 15 years old can lead children across the street, even 14, 15 years old can lead adults and the elderly to cross the street,” Delegate Tran Cong Phan expressed his opinion and said that people with civil capacity and at a certain age can lead children under 7 years old to cross the street. Therefore, the delegate suggested clarifying this in the law.

Regarding the regulation that absolutely prohibits alcohol concentration when driving, delegate Tran Cong Phan said that everything has its right side.
“Absolute ban is correct, but banning at a certain threshold also has its standards. There are very few countries in the world that ban absolutely, people still ban at a certain threshold, only about 20 countries ban absolutely,” said delegate Tran Cong Phan.
According to the delegate of Binh Duong, when absolutely banning, it seems that the impact and influence on traditional issues and customs have not been assessed.
"Sometimes people just want to drink a little wine or a little beer to ensure a very nice and good custom, but driving after just a little bit is not allowed," said delegate Tran Cong Phan.
Therefore, National Assembly Deputy Tran Cong Phan suggested that the Drafting Committee consider choosing a suitable option. Finally, if necessary, two options should be created to solicit opinions from National Assembly deputies, and the option with the majority should be followed.
Speaking at the meeting, delegate Nguyen Quang Huan (Binh Duong delegation) said that at the 6th session in the group discussion session, he suggested not to strictly regulate the alcohol concentration of 0 when driving because he thought we should regulate it in the same trend as the majority of countries in the world.
The traffic police force monitors the level of 0 or 0.25 mg/l of breath, which is equivalent to drinking a 330ml bottle of beer. It is even possible to apply digital testing to determine the sobriety of traffic participants with alcohol concentration before imposing penalties.

The Binh Duong delegation said that during the voter contact before the 7th session, some voters suggested keeping the current alcohol concentration limit at 0 to ensure traffic safety. However, some people also said that such a regulation is too strict.
“Perhaps among the National Assembly delegates sitting here, there are still two different opinions on this issue. However, honestly speaking, both opinions seem to be qualitative, and there is not enough scientific basis to confirm which viewpoint is correct,” Mr. Huan said.
Mr. Huan said that he did not try to defend the view that alcohol concentration is zero or has a threshold because it may be true for one subject but not necessarily true for another. Or it may be true now but not necessarily true 10 years later.
Therefore, Mr. Nguyen Quang Huan suggested that the drafting committee add more convincing grounds for the National Assembly to decide so that the law is passed in a reasonable and sympathetic manner, meeting the aspirations of the majority of the people, so that the Law will have a long life.
The convincing basis here is sociological statistics, such as what percentage of traffic accidents are caused by alcohol. And of those accidents, what percentage is due to exceeding the threshold, mainly at what age? General characteristics of the group of violators.
If the majority of accidents are caused by exceeding the alcohol threshold, and alcohol-related accidents are concentrated in a certain group of people, then it is possible to stratify and apply measures to raise awareness and communication, instead of applying individual factors to the general. That is, in that case, the alcohol concentration should not be set at 0.
“On the contrary, if the data shows that accidents caused by alcohol account for a large proportion, distributed across all age groups, components, and ages, regardless of whether they exceed or fall below the threshold, then the regulation of alcohol concentration of 0 must be included in the law. Only then, when the law is passed, will it ensure strictness and objectivity,” said Mr. Huan.
Receiving and explaining the opinions of the National Assembly deputies, Chairman of the National Defense and Security Committee Le Tan Toi acknowledged all the opinions of the National Assembly deputies. At the same time, he said that he would coordinate with the Government's drafting agency to advise the National Assembly Standing Committee to receive and explain thoroughly and fully to the National Assembly before voting to pass the law.
“Regarding alcohol concentration, taking into account the opinions of National Assembly delegates, we will coordinate with the drafting agency and relevant agencies, especially professional agencies, to continue surveying, collecting data and making further assessments,” said Mr. Le Tan Toi .
