(NLDO) - Although the processing time is set at 1 day, many files at the District 3 Land Registration Office Branch are processed past the deadline.


The Ho Chi Minh City Inspectorate has just issued the conclusion of the inspection of the issuance of certificates of land use rights, house ownership rights and other assets attached to land (referred to as Certificates) in District 3.

Has overdue records of more than 1,000 days

Regarding the settlement of the application for the first Certificate of Land Use Rights of the District 3 Land Registration Office Branch (abbreviated as District 3 Branch), the Ho Chi Minh City Inspectorate randomly inspected 72/189 settlement applications (38%).

According to the Ho Chi Minh City Inspectorate, based on the deadline on the Receipt and Appointment for Return of Results compared with the date of return of results to users, there were 2/72 files that were ahead of schedule (2.78%); 70/72 files that were overdue (97.2%). Of which, the most overdue was 1,145 days (more than 3 years). The Ho Chi Minh City Inspectorate concluded that this was not implemented in accordance with the Government's regulations and did not ensure the settlement deadline according to the regulations of the Ho Chi Minh City People's Committee).

There are 69/72 overdue files that do not have apology letters sent to the people. There are 3/72 overdue files that have apology letters, but have not followed the regulations of the Ho Chi Minh City People's Committee.

According to the inspection conclusion, the coordination between units was not tight. Most of the documents when transferred, the units did not open a tracking book (including District 3 Branch, Ward People's Committee, District 3 People's Committee Office), there was no list of documents delivered and received. The exchange documents did not specify a response time limit, so most of the units were late in informing, there were no timely documents urging and reminding the units.

The Ho Chi Minh City Inspectorate found that the coordination between units was not tight, and that administrative procedures were not fully controlled to promptly urge and remind the progress of the first-time Certificate issuance dossiers. This did not ensure the principle of implementing the one-stop mechanism, the inter-connected one-stop mechanism, and was not in accordance with the regulations of the Ho Chi Minh City People's Committee.

There are 45/72 records without public posting of the ward People's Committee.

District 3 Branch does archive records, however, most of the archived records are not arranged scientifically, not in order, the cataloging of records is not in accordance with the file index form, documents submitted and stored according to the Government's regulations on document work. There are 22/72 records that District 3 Branch does not archive completely.

Regarding secured transactions, the rate of overdue settlement is 2,462/4,269 files (accounting for 57.67%). The Ho Chi Minh City Inspectorate said that although the settlement time is regulated to be 1 day, many files of District 3 Branch were overdue for a maximum of 144 days.

Regarding the records of refusal to resolve administrative procedures for people, after examining 14/928 records, the Ho Chi Minh City Inspectorate found that most of the records refused to resolve had many reasons such as land technical issues (wrong area, incorrect coordinates, road planning boundary, incorrect area between the drawing and the current status...). District 3 branch has a document instructing people to request the Surveying Consulting unit to adjust the current status drawing of the land (this current status drawing has been internally inspected). The Ho Chi Minh City Inspectorate determined that this caused inconvenience to people.

There are many documents with additional instructions many times (3 times) which is not in accordance with the Government's Decree on implementing the one-stop and one-stop mechanism in handling administrative procedures.

There is a file that has 2 current drawings with 2 different internal inspection confirmation units (District 3 Branch, Urban Management Department and District 3 Department of Natural Resources and Environment) which is not implemented correctly compared to Procedure 4114 regarding not requiring 2 drawings.

According to the inspection conclusion, in 2022 and 2023, District 3 Branch received 76 complaints, petitions, and denunciations related to the issuance of Certificates at District 3 Branch. Of these, 67/76 petitions have been processed and 9/76 petitions have not been processed. There are still some shortcomings in the processing of petitions.
Specifically, 76/76 files do not have a leader's submission form.

For the 5 petitions classified as complaints, the petition classification was not in accordance with the regulations of the Government Inspectorate. 4/5 petitions had no processing results.

For the 2 petitions classified as denunciations, 2/2 petitions did not handle the petitions according to regulations (accusing the branch head, not under the authority, not providing instructions, or transferring to the competent authority for handling.

Of the 69 complaints and petitions, 2/7 were received via the National Public Service Portal, and the processing and response time for complaints and petitions did not meet the time limit prescribed by the Prime Minister. Of the 62 complaints received via postal services, the processing time was delayed according to the Document of the HCM City Land Registration Office. In addition, 25/62 complaints did not have a written response to the citizen.

The Ho Chi Minh City Inspectorate said that the above petitions reflected the slow processing time, the extension of the time to issue the Certificate; reflected that District 3 Branch had many documents requesting additional documents many times (more than 3 times); did not provide specific instructions to complete the certificate issuance dossier; reflected the determination of the extended area (within the boundary).

Ho Chi Minh City Inspectorate also said that through checking the records and working with District 3 Branch, this unit confirmed that the content of the people's reflection was correct.
