Accordingly, the Provincial People's Committee requests provincial departments, branches, sectors, People's Committees of districts, cities and towns, based on their functions and tasks, to propagate and disseminate to agencies, units and enterprises the provisions of the law on management and use of foreign labor and Decree No. 70/2023/ND-CP; at the same time, continue to effectively implement the tasks and solutions in Plan No. 154-KH/TU dated February 13, 2023 of the Provincial Party Committee to implement Directive 09-CT/TW dated September 9, 2021 of the Secretariat on attracting, managing and effectively using foreign labor in Vietnam.
Specifically, the Provincial People's Committee assigned the Department of Labor - Invalids and Social Affairs to preside over and coordinate with the Provincial Police, Department of Foreign Affairs, Southeast Economic Zone Management Board , District People's Committees, relevant agencies and units to strengthen management and support organizations and individuals employing foreign workers to work in Nghe An and recruiting and managing Vietnamese workers working for foreign organizations and individuals in the province; at the same time, guide the procedures, reports and documents explaining the need to employ foreign workers, appraise and approve job positions employing foreign workers; grant, re-grant, and extend work permits for foreign workers; revoke work permits of foreign workers, etc.
The Department of Labor, War Invalids and Social Affairs shall preside over and coordinate with departments, branches, the Management Board of the Southeast Economic Zone, the People's Committees at district level, relevant agencies and units to advise the Provincial People's Committee to review, amend and supplement Decision No. 24/2018/QD-UBND dated May 15, 2018 of the Provincial People's Committee on the Regulations on coordination in managing foreign workers working in Nghe An province in accordance with the practical situation of managing and using foreign workers working in Nghe An province.
The Provincial People's Committee also assigned the Southeast Economic Zone Management Board to coordinate with the Department of Labor - Invalids and Social Affairs, departments, branches, localities and relevant agencies and units to propagate and disseminate legal regulations and Decree No. 70/2023/ND-CP on management and use of foreign workers working at enterprises in the economic zone and industrial parks of Nghe An province.
From September 18, 2023, according to Decree No. 70/2023/ND-CP, the Southeast Economic Zone Management Board will stop receiving reports explaining the need to use foreign workers and approve job positions using foreign workers; issue, reissue, extend, revoke foreign work permits; confirm that foreigners are not subject to work permits for foreign workers working at enterprises in economic zones and industrial parks. Advise the Provincial People's Committee to amend and supplement the Decision to promulgate the List of administrative procedures in the field of labor and employment under the jurisdiction of the Southeast Economic Zone Management Board.
For the Provincial Police, the Provincial People's Committee assigned the presiding authority and coordination with departments, branches, localities and relevant agencies and units to strictly manage foreigners, thoroughly prevent foreigners from illegally entering Vietnam to Nghe An province to work for the wrong purpose; inspect the use of foreign workers at units and enterprises, in order to promptly detect foreign workers entering to work without a Work Permit or working at a location, agency, organization, unit, enterprise not on the Work Permit, foreign workers working for the wrong purpose and program; guide agencies, units, enterprises employing foreign workers on visa issuance procedures, temporary residence registration for foreign workers according to regulations; carry out the issuance, amendment, supplementation, and cancellation of the validity of documents issued by Vietnam to foreign workers with the value of exit, entry, residence, etc.
The People's Committees at the district level in the area shall strengthen the guidance and supervision of the implementation of management and use of foreign workers to work at agencies, units and enterprises located in the area; regularly monitor and grasp the difficulties of units and enterprises in implementing legal policies for foreign workers, procedures and documents related to sending foreign workers to work in Vietnam to promptly report to the Provincial People's Committee. Request agencies, units and enterprises in the area to properly implement regulations on management and use of foreign workers working in Vietnam and recruitment and management of Vietnamese workers working for foreign organizations and individuals in Vietnam in accordance with current laws...
